If a Bid Bond is submitted, it shall be in substantially the form set forth in Section C of this Request for Bids. The Bid Bond shall be obtained from a surety that is authorized to conduct business in the State of New Jersey. Bidders shall provide a certificate from a surety company stating that the surety will provide a Performance Bond in the full amount of the contract price if Bidder is awarded a contract. The certificate from the surety shall not contain any conditions to the obligation of the surety. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 etseq. and N.J.A.C. 17:27-1 etseq. (Affirmative Action/EEO). Bidders must also comply with the Public Works Contractor Registration Act, N.J.S.A. 34:11-56.48 etseq., and must submit a current Contractor Registration Certificate either with their bids or no later than prior to the award of a contract by FRANKLIN BOROUGH. Further Bidders shall comply with the Prevailing Wage Act, N.J.S.A. 34:11-56.27 etseq. No bids will be received after the time and date specified above, and no bidder may withdraw its bid within sixty (60) days after bid opening. FRANKLIN BOROUGH reserves the right, pursuant to applicable law, to waive any informalities in the bid or to reject any or all bids. Bid shall be submitted, at the time and place above, in sealed envelopes marked on the outside with the bidders name and the words: Sealed Bid for Tank Maintenance Franklin Meadows Waterspheroid. Bid security, in the amount of 10% of the bid, but not to exceed $20,000.00, must accompany each bid that is submitted. At the option of the bidder, the bid security may be in the form of a certified check, cashiers check or Bid Bond payable to FRANKLIN BOROUGH.
