For the furnishing of all labor, materials, transportation, equipment and services necessary for construction of the HVAC Replacement Types of bids required will be stipulated sum. No bid will be considered unless it is made on the form provided by the Architect and accompanied by cash, cashier's check, certified check or Bidder's Bond from a surety company admitted by the State of California Insurance Commissioner, for 10% of the amount of the bid, made payable to the Owner. Such cash, cashier's check, certified check or bidder's bond shall be given as a guarantee that the bidder will execute the Contract, if it be awarded to him, in conformity with the Contract Documents. Bid shall not expire for a period of thirty-five (35) days after the scheduled closing time set for receipt of bids. The Contractor awarded the project will be required to provide 100% Payment Bond and 100% Performance Bond. Contractor shall possess a valid Class B General Building or C-20 Warm-Air Heating, Ventilating and Air-Conditioning Contractor license issued by the California Contractors State License Board. Owner will affirmatively assure that, in any contract entered into as a result of this advertisement, minority businesses will be afforded full opportunity to submit bids in response to the invitation and will not be discriminated against on the grounds of gender, race, color, religion, national origin, or sexual preference in consideration for an award. BIDDERS are notified that financing for this project is provided pursuant to the Consolidated Farm and Rural Development Act (7 U.S.C. Section 1921 et seq.), and that as allowed in Public Contract Code Section 22300, this contract does not provide for substitution of securities for any monies withheld by the OWNER to ensure performance under the Contract. Bid shall not expire for a period of thirty-five (35) days after the scheduled closing time set for receipt of bids. The Contractor awarded the project will be required to provide 100% Payment Bond and 100% Performance Bond. Contractor shall possess a valid Class B General Building or C-20 Warm-Air Heating, Ventilating and Air-Conditioning Contractor license issued by the California Contractors State License Board. Copies of the prevailing rate of per diem wages are on file and open to public inspection at the office of the Owner, and reference is made specifically thereto. The contractor shall post a copy of the prevailing rate of per diem wages at the job site. Attention is directed to the provisions of Section 1777.5 and 1777.6 of the Labor Code of the State of California concerning employment of apprentices by the contractor or any subcontractor under him. The prime contractor is responsible for compliance with the requirements of Section 1777.5 and the prime contractor and any subcontractor under him shall comply with the requirements of Section 1777.6. The project will be required to conform to the requirements of Assembly Bill 1506 in regard to prevailing wage documentation; refer to Document 00 21 13 - INSTRUCTIONS TO BIDDERS for Labor Compliance Program. A contractor or subcontractor shall not be qualified to bid on, or be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered and qualified to perform public work pursuant to Section 1725.5. It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded. The Owner reserves the right to waive irregularities and reject any or all bids.
