The Brownsville Public Utilities Board (BPUB) is requesting Competitive Sealed Proposals (hereon styled RFP) for Substation Power Transformer Field Service to Remove, Dispose, & Retro-fill Corrosive Oil Each proposal shall be accompanied by a Certified or Cashiers check payable to the order of the Public Utilities Board, City of Brownsville, Texas for a sum not less than five (5%) percent of the total amount bid. In lieu of a check, a Bid Bond may be submitted in an amount not less than five (5%) percent of the total amount bid with a Corporate Surety licensed to do business in the State of Texas, conditioned that the BIDDER will pay the BPUB, as mutually agreed to liquidated damages, and not as a penalty, the amount specified in the Bond unless he enters into a contract in accordance with the bid. If the BIDDER fails to execute the contract and to furnish satisfactory Performance and Payment Bonds and Insurance Certificates within ten (10) days from the date on which they are notified that their Bid has been accepted, the amount of the check or bid bond shall be forfeited to the BPUB as mutually agreed to liquidated damages, and not as a penalty. No proposal will be considered if the Bid Security is not submitted. The BPUB will not be responsible in the event that the U.S. Postal Service or any other courier system fails to deliver the sealed proposal package to the BPUB Purchasing Office by the given RFP deadline above. Electronic transmission or facsimile of RFP will not be acceptable. BPUB reserves the right to reject any or all responses and to waive irregularities contained therein and to accept any response deemed most advantageous to the BPUB.
