The work of this Contract includes, but is not necessarily limited to the following: The project generally consists of modifications of the existing police entrance, the addition of an exterior sally port lift, modifications of exterior stairways, fence enclosure modifications and access gate motor and controller modifications. Each Proposal must be submitted utilizing the forms contained within the Contract Documents. Deviation from this submittal procedure will subject the proposal to rejection. It must be enclosed in a sealed envelope bearing on the outside the name of the BIDDER, his address and name of Project(s) for which the Bid is submitted. Materials to be contained within the sealed envelope are specified under Instructions to Bidders. Bid Proposals shall be complete, in ink, and any Bids incomplete or not submitted in a sealed, specially addressed envelope may be considered informal. Each Bid must be accompanied by a proposal guarantee in the form of a Bid Bond or Certified Check for an amount equal to ten percent (10%) of the full amount of each Contract Bid, not to exceed $20,000. Surety shall be made payable to: Borough of Bay Head, and shall be without condition or qualification. All Bidders shall be required to comply with Chapter 127, P.L. 1975, c. 127, requiring each Bidder and each Subcontractor to formulate and submit to the proper authorized representative of the State of New Jersey an Affirmative Action Program of equal opportunity which guarantees minorities employment in all categories. Bids are required to comply with the requirements of N.J.S.A. 10:5-31 et. seq. and N.J.A.C. 17:27. All bidders must comply with the Prevailing Wage Act, N.J.S.A. 34:11-56.25 et seq. and the N.J.S.A. 34:1B-5.1, Chapter 150 Laws of 1963. If the Bidder is a Corporation or a Partnership, the Bidder, in conformance with Chapter 33, P.L. 1977, shall submit with his Bid, a statement setting forth the names and addresses of all stockholders who own a 10 percent or greater interest in the firm. The Borough reserves the right to waive any informalities or to reject any and all Bids, if it is in the public interest to do so. All questions shall be submitted in writing to the Engineer and shall be postmarked at least ten (10) days before the established date for Bid opening.
