Each bid must conform and be responsive to all pertinent Bidding and Contract Documents. Each bid shall be accompanied by the bid security of cash, a cashiers or certified check, U.S. money order, or bid bond for ten percent (10%) of the amount of the bid made payable to Ventura Unified School District, list of Designated Subcontractors, Non-collusion Affidavit, Qualification Evaluation Sheet and all other documents as required by the Instructions to Bidders. The District has determined that regardless of the Bid Proposal Amount, each bidder on this project must be prequalified with Ventura Unified School District. In addition, if components of the Project will be performed by electrical, mechanical, or plumbing subcontractors performing under the following license classification(s), then each of those subcontractors that intend to bid as a first-tier subcontractor to a general contractor (prime contractor) are required to have been prequalified by the District: C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, and/or C-46. In accordance with Public Contract Code section 20111.5, each bidder must: a) submit a Prequalification Application in accordance with the Instructions for Bidders at least ten (10) business days prior to the last date for the submission of Bid Proposals set forth above, and be prequalified with Ventura Unified School District for at least five (5) business day prior to that date. The Owner will make the site available to bidders for examination during the bid period. Bidders are hereby notified that in accordance with Section 1770 et. seq. of the Labor Code of the State of California, the Director of Industrial Relations has ascertained the prevailing rate of per diem wages, as well as the general per diem rate for legal holidays and overtime for each craft or type of workman needed to execute the contract which will be awarded to the successful bidder. Said wage scale is hereby made part hereof by reference thereto and such rates are on file and open to public inspection at the office of the Ventura Unified School District. This project is a public work as defined within California Labor Code Section 1720. The Contractor shall post a copy of the determination of prevailing rate of wages at each job site. The Contractor and any subcontractor(s) shall pay not less than the specified prevailing rate of wages to all workers employed by them in the execution of the contract. Monitoring and enforcement of prevailing wage laws and related requirements will be performed by the Labor Commissioner/Department of Labor Standards Enforcement (DLSE). Contractor and all subcontractors shall furnish certified payroll records as required pursuant to Labor Code section 1776 directly to the Labor Commissioner in accordance with Labor Code section 1771.4 on at least a monthly basis (or more frequently if required by the District or the Labor Commissioner) and in a format prescribed by the Labor Commissioner. The District reserves the right to withhold contract payments if the District is notified, or determines as the result of its own investigation, that Contractor is in violation of any of the requirements set forth in Labor Code section 1720 et seq. at no penalty or cost to the District. No contractor or subcontractor may be listed on a bid proposal for a public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5. No contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5. Contractor is hereby made aware of the requirements of Education code section 45125.1 which requires employees of any entity that has a contract with a school district to have certain employees who will have contact with students to be fingerprinted pursuant to that law. The successful bidder will be required to furnish a labor and material bond in an amount equal to one hundred percent (100%) of the contract price, and a faithful performance bond in an amount equal to one hundred percent (100%) of the contract price, said bonds to have sureties satisfactory to the Ventura Unified School District. In accordance with the provisions of PCC 22300, substitution of eligible and equivalent securities for any monies withheld to ensure performance under this contract will be permitted at the request and expense of the contractor. Each bidder shall possess at the time of bid a Class B Contractors License, pursuant to Public Contract Code Section 3300 and Business and Professions Code Section 7028.15. The successful bidder must maintain the license throughout the duration of the contract. No bidder may withdraw his bid for a period of ninety (90) days after the date set for the opening thereof. The District reserves the right to reject any or all bids and/or accept any bid if such action is in the best interest of the District. The District reserves the right to waive irregularities in any bid. The District may award a contract on an individual project or combination of projects, whichever is to the best interest of the District. The bidder may specify that the District acceptance of one project shall be contingent upon the District's acceptance of one or more additional projects submitted on the same bid. In the event of this bid containing additive or deductive alternates, the lowest bid shall be determined in a manner that prevents any information that would identify any of the bidders from being revealed to the public entity before ranking of all bidders from lowest to highest has been determined.
