Site work for a water / sewer project in Hoboken, New Jersey. Completed plans call for site work for a water / sewer project.

The Project consists of the green infrastructure construction of ten (10) stormwater planters along Park Avenue. Four (4) planters shall be located between 46th and 47th Street in Weehawken, and six (6) stormwater planters shall be located outside the school north of 52nd Street in West New York. Prospective Bidders may examine the Bidding Documents at the Office of the North Hudson Sewerage Authority, 1600 Adams St., Hoboken, NJ 07030, on Mondays through Fridays between the hours of 9:00 am and 4:00 pm and may obtain copies of the Bidding Documents as described below. Bidding Documents may be obtained from the Office of North Hudson Sewerage Authority during the hours indicated above. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the prospective Bidder's date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office. If the Contract is awarded, no refunds will be given. If for any reason the Contract is not awarded, refunds will be made to bidders pursuant to N.J.S.A. 40A:11 24(b) when the Contract Documents are returned in reasonable condition within 90 days of notice that the Contract has not been awarded. The Owner will evaluate bids and any award will be made to the lowest, responsive, respon-sible bidder in accordance with N.J.S.A. 40A:11-6.1. A copy of N.J.S.A. 40A:11-6.1 is included in Section entitled Local Public Contract of this specification. The Owner reserves the right to reject any or all bids and to waive minor informalities or irregularities in bids received. The qualification and reclassification of bidders will be subject to the statutory provisions contained in N.J.S.A. 40A:11-25 to 32 ("Local Public Contract Law"). A copy of N.J.S.A. 40A:11-25 to 32 is included in the Section entitled "Local Public Contract Law" of this specification. Bidders are required to comply with all relevant Federal and State Statutes, Rules and Regulations including but not limited to the applicable provisions of Title VI of the Civil Rights Act of 1964, as amended (42 USC 2000d 2000D 4A), the discrimination and affirmative action provisions of N.J.S.A. 10:2 1 through 10:2 4, the New Jersey Law against Discrimination, N.J.S.A. 10:5 1, et seq., the rules and regulations promulgated pursuant thereto, the State require-ment for bidders to supply statements of ownership (N.J.S.A. 52:25 24.2) and the State requirement for submission of the names and addresses of certain subcontractors (N.J.S.A. 40A:11 16). The Contract or Subcontract will be subject to regulations contained in Local Public Contract Law, Department of Labor Current Wage Rate Determination, Prevailing Wage Act, Contract Work Hours and Safety Standard Act, Copland Act, Davis Bacon Act, Buy American Clause, and Debarment and Suspension. Pursuant to P.L. 2009, c.315 (N.J.S.A. 52:32-44) effective January 18, 2010, all business organizations that conduct business with a New Jersey government agency are required to be registered with the State of New Jersey. Bidders and their subcontractors must submit proof that they are registered with the New Jersey Department of Treasury, Division of Revenue by submitting a copy of their Business Registration Certificate prior to Contract award. Pursuant to N.J.S.A. 10:5 31 et seq., bidders are required to comply with the requirements of P.L. 1975 c. 127, NJAC 17:27. Each Bidder must submit with his bid an "Ownership Disclosure Statement" and "Non-Collusion Affidavit" on the forms included in the Contract Documents. Bidders and their subcontractors of any tier must comply with all applicable provisions of the Public Works Contractor Registration Act, P.L. 1999, c. 238 (N.J.S.A. 34:11-56.48) and the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25). Bidders will be subject to penalties for falsification in accordance with the statutory provisions contained in N.J.S.A. 40A:11-33 to 34 ("Local Public Contract Law"). Bid bond A person bidding on a contract for the erection, alteration or repair of a public building, structure, facility or other improvement to real property, the total price of which exceeds $100,000, shall furnish a guarantee as provided for herein. A contracting unit may provide that a person bidding on any other contract, advertised in accordance with law, shall furnish a guarantee as provided for herein. The guarantee shall be payable to the contracting unit so that if the contract is awarded to the bidder, the bidder will enter into a contract therefor and will furnish any performance bond or other security required as a guarantee or indemnification. The guarantee shall be in the amount of 10% of the bid, but not in excess of $20,000.00, except as otherwise provided herein, and may be given, at the option of the bidder, by certified check, cashier's check or bid bond. In the event that any law or regulation of the United States imposes any condition upon the awarding of a monetary grant to any contracting unit, which condition requires the depositing of a guarantee in an amount other than 10% of the bid or in excess of $20,000.00 the provisions of this section shall not apply and the requirements of the law or regulation of the United States shall govern. Surety bonds (g) All applicable surety bonds required in connection with the advertisement and award of building contracts or subagreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570Surety Companies Acceptable on Federal Bonds), incorporated herein by reference. Copies of this document may be obtained from the Department. It is the purpose of this Notice to Bidders to summarize some of the more important provisions of the Contract Documents. Prospective bidders are cautioned not to rely solely on this sum-mary, but to read the Contract Documents in their entirety.
