Each bidder must submit with his bid a certified or a cashier's check upon some reputable bank of the State of Minnesota, payable to the City of Moorhead, for at least 5 (five) percent of the total amount of such bid, which check and the amount thereof, shall be forfeited to the City of Moorhead, as liquidated damages if the bidder upon the letting of the contract to him, shall fail to enter into the contract so let. The bidder may submit a bidder's bond written through an insurance agency or cash in the same amount in lieu of a certified check.
