As evidence of good faith and guarantee that contract will be entered into should award be made thereon, a certified check or bid bond in the amount of 5% of the bid must accompany bid. City reserves the right to accept or reject any or all bids in whole or in part, and the bidders shall have the right to appeal any decision to the City Council. Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda delivered to all parties recorded as having received the Bidding Documents. Questions received less than 8 calendar days prior to the date for opening of Bids may not be answered. Only questions answered by formal written Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect.
