The Work under this Project consists of the raising and replacing Burton's Point Road for approximately 1,800 feet and roadway improvements to Elm Avenue to include new curb and gutter, sidewalk, and mill and overlay. Bid Security in the amount of five percent ( 5 %) of the Bid shall be submitted with each Bid. Withdrawal of Bids due to error shall be subject to and in accordance with Section 2.2-4330 of the Code of Virginia and the Contract Documents. The Owner reserves the right to waive minor non-substantive informalities in the Bid, to reject any/or all Bids, to award any Bid in whole or in part and award the Bid considered to be in the best interest of the Owner. The Owner also reserves the right to negotiate with the lowest responsive, responsible Bidder should Bid exceed available funds. Bidders submitting bids to provide goods and services to the City of Portsmouth shall exercise good faith efforts to comply with the City of Portsmouth M/WBE goals for the contract that are included in this solicitation. Any act or omission by the City shall not relieve the contractor of this responsibility. The City reserves the right to reject any bid and deem it non-responsive for failing to meet its M/WBE program policy requirements, including the submission of required documents.
