NOTICE IS ALSO GIVEN that Bids must be from contractors holding a State of California Class B-General Building Contractor License. Bids must be sealed and accompanied by certified check, cashier's check, or bid bond made payable to the County of San Joaquin in the sum of not less than ten percent (10%) of the amount of the Bid. The check or bonds shall be given as a guarantee that the successful bidder will enter into a written contract within ten (10) calendar days after being requested to do so and will be considered as the stipulated amount of liquidated damages in the event the bidder is unable to or refuses to execute a contract for the work. NOTICE IS ALSO GIVEN that as part of a Bid submittal, the Bidder must have satisfactorily and successfully completed at least two (2) projects as a General Contractor in the last ten (10) years from the Bid release date, with such projects being of similar size and scope as San Joaquin General Hospital s Radiology Room 1324 Siemens CT Scan. The two (2) qualifying projects must include: 1) been a Hospital facility subject to Healthcare Access and Information (HCAI) review and inspection; and 2) included remodel work in an occupied hospital. The Prime/General Contractor shall be required to provide at least two (2) references under which the Prime/General Contractor and specialty subcontractors have provided similar services in the last ten (10) years from the Bid release date. NOTICE IS ALSO GIVEN that the general prevailing wage rates have been determined by the Director of the California Department of Industrial Relations (DIR) and it shall be mandatory upon the contractor to whom the contract is awarded, and upon any subcontractor, to pay not less than these specified rates to all laborers, workmen, mechanics and apprentices employed by them in execution of the contract, all in accordance with the provisions of Labor Code Sections 1770 through 1781, inclusive. California Labor Code Section 1771.1(a): A contractor and subcontractors shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in the chapter, unless currently registered and qualified to perform public work pursuant to Section 1725.5. It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded. Prevailing Wage Rates: In accordance with the provisions of Labor Code Sections 1770 through 1781, the general prevailing rate of wages, as determined by the Director of the DIR, shall be paid to all trades performing work under this Contract. The work is subject to compliance monitoring and enforcement by the DIR. No contractor or subcontractor may be awarded a contract, on a public works project, on or after April 1, 2015, unless registered with the DIR pursuant to Labor Code Section 1725.5. Additionally, on or after January 1, 2016, contractor and subcontractor shall be required to furnish electronic certified payroll record to the Labor Commissioner for all public works projects, new or ongoing. Additional information about these requirements, SB 854, and the new public works program regarding compliance monitoring, administration, and enforcement of prevailing wage law is available on the DIR s portal Contractor will be required to submit DIR registration numbers for their company and all subcontractors. Contractor shall provide for themselves and for each subcontractor the DIR PWC100 contractor/subcontractor registration number or registration page confirming the Contractor s subcontractors registration with DIR. NOTICE IS ALSO GIVEN that San Joaquin County has adopted a goal to strongly encourage local hire participation in the construction workforce in accordance with Board of Supervisors policy. Contracts estimated by the County to be less than $200,000 do not have a local hire goal. The Local Hire Information Form and Checklist is optional, but preferred, with the bid submittal to demonstrate attempts to employ local hire. NOTICE IS ALSO GIVEN that Bids shall be made upon the form provided by the County and shall be properly completed with all items filled out; numbers shall be in writing and figures; the signatures of all persons signing shall be in longhand. No bidder may withdraw his bid for a period of sixty (60) calendar days after the time set for the opening of bids, and the Board will act to accept or reject bids within that period of time. NOTICE IS ALSO GIVEN that upon the Contractor's request, the County will make payment of funds withheld from progress payments pursuant to the requirements of Public Contract Code Section 22300 if the contractor deposits in escrow with the County s Treasurer-Tax Collector, or with a bank acceptable to the County, securities eligible for the investment under Government Code Section 16430, bank or savings and loan certificates of deposit, interest-bearing demand deposit accounts, standby letters of credit, or any other security mutually agreed to by the Contractor and the County. The escrow agreement between the Contractor and the County in this regard shall be substantially similar to the form set forth in Public Contract Code Section 22300(f). NOTICE IS ALSO GIVEN THAT the Board of Supervisors reserves the right to reject any or all bids, and further reserves the right to waive any informalities or irregularities in the bids.
