Proposals received after the time set for opening will not be considered and will be returned unopened. Also, bids received more than ninety-six (96) hours prior to the time set for opening, excluding Saturdays, Sundays and holidays will not be considered. Bidders are responsible for ensuring their bid is received by the date and time specified. Issuance of this bid request in no way constitutes a commitment by the City to award a contract or to pay any costs incurred in preparation of a response to this request. This bid request does not represent a commitment by the City to do business with any vendor or the vendor who submits the best proposal. The City will select the proposal, or combination of proposals that, in its opinion, is in the best interest of the City. The City reserves the right to cancel this bid, reject all proposals, and seek new proposals through a new bid request or other means. The City reserves the right of evaluation and the right to determine the methodology for evaluation of the proposals to determine and accept the proposal (or proposals) deemed to be in the best interest of the City; i.e., the most qualified proposal will not necessarily be the proposal of lowest cost. The City reserves the right to award the bid to any vendor or combination of vendors. Attention is called to the requirement that the successful bidder must comply with all local, state, and federal laws, regulations and policies applicable to this contract unless specifically excluded herein. No bidder may withdraw his proposal within thirty (30) days after the actual date of opening thereof. REQUIRED: If a bidder submits a bid in excess of $100,000.00, the bidder shall accompany their bid with a certified check, cashier's check or bid bond equal to five percent (5%) of the bid amount. Any insurance or bond shall be secured from an insurance or indemnity carrier licensed to do business in the State of Oklahoma. (Oklahoma State Statutes Title 61, Section 107) The City reserves the right to reject any, and all proposals submitted under this document, waive irregularities or technicalities and to make awards in the best interest of the City of Sallisaw or the Sallisaw Municipal Authority. In order for Contractor proposals to be considered, the Contractor must demonstrate that they are qualified and have the technical knowledge and experience to perform the specified work.
