Reference number : 1682359 Deadline for receipt of complaints: 2023-01-30 Submission sent electronically accepted: Yes, in a single submission document Options related to this notice: This notice has renewal options (two options of one year each) Expected duration of the contract without the options (in months): 12 The École de technologie supérieure having its head office at 1100 rue Notre-Dame Ouest, Montréal (hereinafter "Owner"), is requesting Tenders for the purpose of allocating a work-on-demand contract for the rental of containers and the collection of containers of dry waste destined for a sorting centre, the approximate monetary value of which is estimated at seventy-five thousand dollars ($75,000). This service is required for the Owner's campus located in Montreal in the quadrangle of Ottawa, de la Montagne, St-Jacques and Montfort streets. Contract duration and renewal option The start of the Contract is March 1, 2023. The Contract will be valid for a period of one (1) year with the option of renewal for two (2) subsequent periods of one (1) year each under the same conditions and at the sole discretion of the Owner. The Owner will send the Contractor, thirty (30) days before the end of the Contract, a notice mentioning the renewal of the Contract, if applicable. However, the Owner reserves the right, at its sole discretion, to terminate the Contract as soon as the amount of the work carried out reaches the Value of the Contract, regardless of the time elapsed between the start of the Contract and that moment. Intergovernmental agreements The following Agreements apply to this Notice of Qualification: Canadian Free Trade Agreement; Trade and cooperation agreement between Quebec and Ontario; Eligibility requirements The failure of a Bidder to meet any of the eligibility conditions described in this call for tenders renders him ineligible for the presentation of a Bid. To this end, the Bidder: and its employees must have the necessary qualifications, authorizations, permits, licenses, registrations, certificates, accreditations and certificates; more specifically and without limiting the generality of the foregoing, the Bidder: must have or must do business with a sorting center holding a certificate of authorization from the Ministry of the Environment of the province in which it is located and which authorizes the sorting of dry residues of materials from Quebec. must hold the Attestation de Revenu Québec, as described in clause 1.15; and its directors must not have performed one or more acts described in the Bidder's Probity Attestation Form (Appendix II. ). The Bidder must sign a declaration to this effect, as specified in clause 1.16; must hold the insurance cover specified in clause 2.04.01 or provide a letter of undertaking issued by an insurance company stating that if the Contract is granted and accepted, it will issue insurance cover in accordance with the description provided to clause 2.04.01; must have in Quebec or in a territory covered by an applicable intergovernmental agreement, an establishment where he carries out his activities on a permanent basis, clearly identified in his name and accessible during normal office hours; must not be registered in the Register of enterprises ineligible for public contracts (RENA) or, if registered, that his period of ineligibility for public contracts has ended, as detailed in clause 1.12; must be a legal person governed by private law, a general, limited or joint-venture partnership or a sole proprietorship; must hold the authorization to contract with a public body prior to obtaining a public contract issued by the Autorité des marchés publics (AMP), as detailed in clause 2.05, if the amount of the Bid requires it ; must meet any other eligibility condition set out in the Tender Documents. Compliance requirements Any Submission with one of the following non-conformities will be deemed non-compliant and will be automatically rejected: failure to meet the date and time limit set for receipt of Submissions; the Submission Form (Annex I. ) was not used to submit the Submission, as required in clause 1.09; the price submitted was not indicated on the Bid Form (Annex I. ), as required in clause 1.09; the Submission Form (annex I. ) has not been signed by an authorized person, as required in clause 1.09; a deletion or correction made to the price submitted and not initialed; a Conditional or Restrictive Bid; the fact that the Submission transmitted electronically was not transmitted through the SÉAO or the fact that it is unintelligible, infected or otherwise unreadable once its integrity has been established by the SÉAO; the Tender that includes an abnormally low price within the meaning of the Regulation respecting certain service contracts of public bodies; if the Bidder submits more than one Bid for this RFP, all Bids submitted by the Bidder will automatically be rejected. For the purposes of this paragraph, the transmission of the same Submission electronically and in paper form is deemed to be the filing of several Submissions; failure to comply with any other condition of compliance indicated in the Bidding Documents as resulting in the automatic rejection of a Bid. In addition, a Submission transmitted on paper containing one of the following non-conformities will be deemed non-compliant and will be automatically rejected: non-compliance with the location provided for the receipt of Bids; the Submission Form (Annex I. ) was not returned in the Submission envelope; the Submission was not presented in an opaque and sealed envelope, as required in clause 1.09; Any omission or error other than those referred to in the preceding paragraphs with respect to a Submission will not necessarily result in the rejection of the Submission. The Owner may allow the Bidder to correct it within a time period that it will determine. The correction made must be to the satisfaction of the Owner and cannot lead to an increase in the price submitted. In the case of a Bid transmitted electronically whose integrity has not been established, the Bidder must remedy this irregularity within two (2) working days following the notice of default sent by the Owner. Failure of the Bidder to perform within the time limit will result in the rejection of the Bid. A Submission transmitted electronically within the time limit set to remedy the lack of integrity of a Submission previously transmitted replaces the latter as soon as its integrity is noted by the Owner. This Submission is then deemed to have been transmitted before the deadline date and time set for the receipt of Submissions. Request for information regarding the call for tenders All requests for information concerning the call for tenders must be directed exclusively in writing, by e-mail to the attention of: Philippe Lacombe Procurement Officer Superior Technology School Email: submissions@etsmtl.ca Failure by the Bidder to comply with the procedure provided for requesting information may result in the rejection of his Bid. No verbal information is binding on the Owner and may be construed as modifying the Tender Documents. Appointments for the transmission of a Paper Submission can be obtained by writing to: submissions@etsmtl.ca no later than 72 hours before the deadline date and time set for the receipt of Submissions. Bidders should note that appointments will be given on limited time slots. Fax or e-mail are not acceptable methods of transmission. Any Submission that does not comply with the conditions set out above will be automatically rejected. Subject to what is provided for in the last paragraph of the General Compliance Conditions clause, the Owner will reject any Submission that is not received no later than the date and time mentioned above for the presentation of the Submissions. In addition, the Owner is not responsible for the delays inherent in the electronic transmission of Bids via SÉAO or in the internal transmission of any paper transmission that is not received directly at the Owner's Finance Department (Procurement). Other reasons for a Bidder's refusal The Owner reserves the right to refuse any Bidder who, during the two (2) years preceding the opening date of the Bids, has been the subject of an unsatisfactory performance evaluation by the Owner, has failed to respond to a Submission or a contract or has been the subject of a contract termination due to its failure to comply with its terms. Full submission for single award The Owner does not undertake to accept either the lowest or any of the Tenders received, nor to carry out the object of this call for tenders, nor to carry out only a part thereof and may, at its sole discretion, not carry out anything in link with this invitation to tender and this, without any compensation for the Bidders. Linguistic interpretation Please note: In this document, any term referred to in the masculine also includes the feminine and vice versa. Similarly, any term mentioned in the singular includes the plural and vice versa.
