For Water System Improvements NOTICE TO BIDDERS ON PROPOSED PLANS AND SPECIFICATIONS, PROPOSED FORM OF CONTRACT AND ESTIMATES OF COST FOR THE CONSTRUCTION OF 2023-2 WATER SYSTEM IMPROVEMENTS, -- 81ST STREET, DOUGLAS AVENUE TO MADISON AVENUE, MADISON AVENUE -- 81ST STREET TO 82ND STREET, FOR THE URBANDALE WATER UTILITY, URBANDALE, IOWA, AND THE TAKING OF BIDS THEREFOR The Board of Trustees of said Water Utility will meet in said Board Room at 3720 86th Street of said City at 4:30 P.M. on Tuesday,, 14th day of February, 2023 and hold a public hearing on the plans and specifications, form of contract and estimate of cost and any interested person may appear and file objections to said plans and specifications, form of contract, or to the cost of said improvements. Proposals will be acted upon by said Board at that time or at such time and place as then may be fixed. Furnish all labor, materials and equipment required for installing open cut 634 linear feet of 8" PVC, 160 linear feet of 6" PVC, 1-8" valve, 2-6" x 6" TS&Vs, 1-8" x 8" tee, 3- 8" x 6" reducers, 13' of 6" PVC pipe for connection, 2-45 deg. 6" bends, 8" bends as needed and two hydrants. Furnish all labor, equipment and materials as outlined on the estimate project quantities including but not limited to, connections to existing system, tracer wire, polyethylene encasement, hydrant auxiliary valve, valve boxes, caps, plugs, 1" corporation cocks and saddles, also furnishing all labor, materials and equipment for removal and replacement of concrete street, driveway, curb and gutter and 4' wide sidewalk removal and replacement, surface removal and preparation for sodding, traffic control, and miscellaneous associated work including cleanup. All work and materials shall comply with the proposed plans, specifications and proposed form of contract now on file with the General Manager. Said documents are by reference made a part hereof, as though fully set out and incorporated herein. Each proposal shall be made out on a blank form furnished by the Board and must be accompanied in a sealed envelope with a second sealed envelope including either (1) a certified or cashier's check, drawn on a solvent Iowa bank or a bank chartered under the laws of the United States, or a certified share draft drawn on a credit union in Iowa or chartered under the laws of the United States, in an amount equal to 10% of the bid or (2) a bid bond executed by a corporation authorized to contract as a surety in the State of Iowa, in the penal sum of 10% of the bid. The bid security should be made payable to the Urbandale Water Utility. The bid security must not contain any conditions either in the body or as an endorsement thereon. The bid security shall be forfeited to the Board as liquidated damages in the event the successful bidder fails or refuses to enter into a contract within ten (10) days after the award of contract and post bond satisfactory to the Board insuring the faithful fulfillment of the contract and the maintenance of said work, pursuant to the provisions of this notice and the other contract document. Bidders shall use the bid bond form included in the specifications. All bids shall be submitted to the General Manager, Urbandale Water Utility, on or before the time specified above. Each bid proposal shall include a "bidder status form". The form is included on pages NB -- 4 & 5. Failure to submit a fully completed bidder status form with the bid may result in the bid being deemed nonresponsive and rejected. At said hearing, the Board will consider the plans and specifications, proposed form of contract and estimate of cost for the project, the same now being on file in the office of the General Manager, reference to which is made for a more detailed and complete description of the proposed improvements, and at said time and place the Board will also receive and consider any objections to said plans, specifications, form of contract or to the estimated cost of said improvements made by any interested party. By virtue of statutory authority, a preference will be given to products and provisions grown and coal produced within the State of Iowa, and preference will be given to Iowa domestic labor in the construction of the improvements. The Board reserves the right to reject any and all bids, to waive informalities or technicalities and to enter into such contract, as it shall deem to be to the best interests of the Board. The Board will award contract on the basis of then lowest responsive bid either with or without sodden. The Board reserves the right to defer acceptance of any proposal for a period not to exceed forty five (45) calendar days from the date of hearing and letting. The successful bidder will be required to furnish a bond in an amount equal to one hundred percent (100%) of the contract price. Said bond to be issued by a responsible surety approved by the Board and shall guarantee the faithful performance of the contract and the terms and conditions therein contained. Said bond shall protect and save harmless the Board from claims and damages of any kinds caused by the operation of the contractor. Said bond shall also guarantee the maintenance of the improvements for a period of four (4) years from and after completion and acceptance by the Board. All work on this project shall complete within ninety (90) calendar days and must be completed by June 16, 2023. Work under the contract shall commence within ten (10) calendar days after date set forth in written Notice to Proceed, and shall be completed, subject to any extensions of time which may be granted by the Board, within ninety (90) consecutive calendar days. Liquidated damages in the amount of Five Hundred Dollars ($500) per calendar day will be assessed for each day that the work shall remain uncompleted after the end of the contract period. These takes into account all due allowances for extensions of the contract period due to conditions beyond the control of the contractor. Payment to the contractor will be made in cash derived from past earnings of the Water Utility or from such funds as may be legally used for such purposes. The contract shall not be an obligation of the City of Urbandale, Iowa, or be enforceable in any manner by taxation. Payment to the contractor will be on the basis of monthly estimates equivalent to ninety-five percent (95%) of the contract value of the work completed during the preceding calendar month. Estimates will be prepared on the last day of each month by the Contractor, subject to the approval of the Water Utility. Payments made shall in no way be construed as an act of acceptance for any part of the work partially or totally completed. Upon completion of the work and its acceptance by the Board, the Contractor will be paid an amount, which, together with previous payments, will equal ninety-five percent (95%), of the contract price. Final payment of the remaining five percent (5%) will be made not less than thirty (30) days after completion and acceptance by resolution of the Board of the completed contract, subject to the conditions and in accordance with the provisions of Chapter 573 of the Code of Iowa, as amended. No such partial or final payment will be due until Contractor has certified to the Board that the materials, labor and services involved in each estimate have been paid for in accordance with the requirements stated in the specifications. Before final payment is made, the Contractor shall submit to the Board a statement of all sales tax or use tax paid on materials and equipment incorporated in the complete construction. Plans and specifications governing the construction of the proposed improvements and the proceedings of the Board referring to and defining said improvements are hereby made a part of this notice and the proposed contract by reference and the proposed contract shall be executed to comply therewith.
