Portion Any Contract or Contracts awarded under this Advertisement for Bids are expected to be funded in part by a loan from the Illinois Environmental Protection Agency (IEPA) and a Community Development Block Grant (CDBG) funded by the US Department of Housing and Urban Development (HUD) awarded through the State of Illinois' CDBG program and will be subject to Davis Bacon Labor Standards and Section 3 requirements. Neither the State of Illinois nor any of its Departments, Agencies, or employees is or will be a party to this Advertisement for Bids or any resulting Contract. The Procurement will be subject to regulations contained in the Procedures for Issuing Loans from the Public Water Supply Loan Program (35 IAC Part 662), the Federal Davis-Bacon Wage act (40 USC 276a through 276a-5) as defined by the United States Department of Labor, the Employment of Illinois Workers on Public Works Act (30 ILCS 570), Illinois Works Jobs Program Act (30 ILCS 559/20-1), and the federal "Build America, Buy America Act" requirements contained in the Infrastructure Investment and Jobs Act, Pub. L. No. 117-58. This procurement is also subject to the Loan Recipient's policy regarding the increased use of Disadvantaged Business Enterprises. The Loan Recipient's policy requires all bidders to undertake specified affirmative efforts at least sixteen (16) days prior to bid opening. The policy is contained in the Specifications. Bidders will also be required to comply with the President's Executive Order No. 11246, as amended. The requirements for bidders and contractors under this order are explained in 41 CFR 60-4. Attention is called to the fact that 1) not less than the Federal prevailing wages as set forth in the Contract Documents must be paid on this project; 2) The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u , which requires to the greatest extent possible, businesses and employers working on HUD-funded projects must make a good faith effort to train and employ low-income individuals living in the local area and to contract with businesses owned by or that employ Section 3 workers. and 3) that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, or national origin. Bidders must have a SAM Unique Entity ID assigned and a complete, active SAM registration prior to contract award [85 FR 49523, 25.205], and not be excluded from participating in any federal assistance program [24 CFR 85, Subpart C 85.35]. The submission of a proposal or bid by the Offeror in response to this IFB or RFP constitutes an acknowledgment of and an agreement by the Offeror that it understands and will comply with the Federal Davis-Bacon Wage Act and the Illinois Preference Act.
