NOTICE TO CONTRACTORS SEALED PROPOSALS will be received by Dolores Martinez Wooden, M.S.C.E., LEED AP, the Director of the Department of Engineering, City of Newark of the State of New Jersey at City Hall, 920 Broad Street in Room #412, and there publicly opened and read aloud for Fairmount Heights Park Block 1813 and Lot 31, 211-217 12th Avenue in the City of Newark, New Jersey Contract NO. 2023-04_ NO BIDS WILL BE ACCEPTED AFTER THE BID OPENING HAS COMMENCED. The City accepts no responsibility for any bids prior to their presentation at the date and hour indicated for the formal bid opening. No bid will be accepted after the date and hour named. Bidders may not withdraw their respective bids for a period of sixty (60 days) days after the receipt of the same by the City of Newark unless otherwise permitted by statute. Bids shall be in accordance with plans and specifications prepared by the City of Newark. The proposed project consists but not limited to, play structures, safety surface, landscaping, fieldwork, and all site amenities. All question regarding the project shall be submitted no later than February 2, 2023 Inquiries regarding the Bid Specifications and Contract Documents shall be sent by email or fax to Joseph Campos , City of Newark, Department of Engineering, Email: camposj@ci.newark.nj.us, Fax: (973) 733-4772. No oral response to any question by any City of Newark employee or agent shall be binding on the City of Newark or in any way considered a commitment by the City of Newark. All Bids are subject to and will abide and comply with all applicable Federal, State and Local Laws and regulations. Any omission of a specific requirement of language by law shall be construed as written fully herein. During the performance of this contract, the contractor is required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 regarding affirmative action. An Initial Project Workforce Report will be required from the successful bidder (Form AA-201). Statement of Ownership Requirement: Pursuant to N.J.S.A. 52:25-24.2, Bidders shall submit a statement setting forth the names and addresses of all persons and entities that own ten percent or more of its stock or interest of any type at all levels of ownership. Each bid must be accompanied by a certified check, cashier's check, or bid bond in the amount of ten percent (10%) (Not to exceed $20,000) of the total bid, payable to the Owner, as a guarantee that if the contract is awarded to the Bidder he will enter into a contract with the Owner. The successful Bidder will be required to furnish payment and performance bonds each in an amount equal to one hundred percent (100%) of the contract award. Each Bidder shall submit with his proposal a completed Consent of Surety Form, stating that the surety company will provide him with the required payment and performance bonds. Bidders are required by law to submit a Statement of Ownership Disclosure form statement setting forth the names and addresses of all persons and entities that own ten (10%) percent or more of its stock or interest of any type at all levels of ownership. The bid package will also include other documents that must be completed and returned with the bid. Failure to comply with Instructions to Bidders and to complete and submit all required forms may be cause for disqualification and rejection of the bid. All contractors named in this proposal, shall possess a valid Public Works Contractor's Registration Certificate pursuant to N.J.S.A. 34:11-56.48 et seq., at the time the proposal is received by the City of Newark. Pursuant to Newark City Ordinance #2:2-28.3 and 2:2-28.4, the contractor must set aside at least twenty-five per cent (25%) of the total contract bid price to a Minority owned Business Enterprise (MBE)or Enterprises plus an additional seven per cent (7%) to a Women owned Business Enterprise (WBE) or Enterprises; the total set aside (%) through either joint venture arrangements, partnerships, subcontracts, the purchase of goods and services or any other method available. The term (MBE) or (WBE) means a business independently owned and operated, as defined in City Ordinance 2:2-28.3 and 2:2-28.4, in which at least fifty-one (51%) percent of the stock is owned beneficially and controlled by persons who are African American, Hispanic, Asian American, American Indian or a Woman and certified as such by a governmental entity. Successful Bidders will be required to attend a meeting with and obtain a clearance from the City's Office of Affirmative Action prior to execution of the contract. NOTE: the contractor can participate in the Newark Minority Resident Employment Incentive Program. A credit of 5% in contract (MBE) dollar commitment will be allowed, if a Newark domiciled Journey worker/apprentice is engaged in the performance of the contract. A credit of 2 man hours for every 8 man hours worked by a Newark domiciled Journey worker on any given day. BASED UPON THE SPECIFICATIONS, THE CITY RESERVES THE RIGHT TO REJECT ANY AND ALL BIDS, TO WAIVE INFORMALITIES AND TO AWARD THE CONTRACT TO THE LOWEST RESPONSIBLE BIDDER IN A MANNER DEEMED IN THE BEST INTERESTS OF THE CITY.
