HEAVY HIGHWAY EQUIPMENT: a) General: Contractor shall furnish and operate equipment under the terms of this contract. Contractor shall provide experienced operators and technical personnel. b) Qualifications: Contractor shall provide a list of past references to verify past work experience of the operators, technical personnel, use and function of the selectedequipment. i. County reserves the right to reject any bid, equipment, operator or technical personnel, if in the opinion of the County, the Contractor labor or equipment is not qualified to complete the work in an expeditious manner. Contractor's bid shall be considered non- responsive unless the submitted bid meets the following conditions: 1. Contractor submits evidence of at least fifteen (15) years of satisfactory heavy highway and bridge construction experience. 2. Contractor submits evidence employees have satisfactory experience operating equipment. c) Evaluation: The County reserves the sole right to make all investigations or inquiries necessary to RFB-2489 Infrastructure Page 18 of 41 1/18/2023 determine the competence and ability of the bidder to properly perform the work. If after an investigation the County is not satisfied the bidder is properly qualified to meet all requirements herein and to perform all work in a satisfactory manner, the County may determine the bid is not responsive. d) Heavy Highway Equipment: The County recognizes the need for equipment on an as-needed basis to complete the work provided in these specifications and to augment County equipment used to complete "in-house" projects. Throughout the course of the year emergency situations, workload or equipment failures may necessitate acquiring equipment on an "as-needed" basis. Equipment furnished shall include operators, support personnel, fuel, maintenance and repairs except where specifically stated otherwise. All equipment shall comply with NYSDOT requirements for equipment. All equipment shall be properly licensed, rigged and marked to meet all requirements of applicable laws and regulations of NYSDOT. i. Condition: All equipment used shall be modern, in good repair, owned/leased and operated by the Contractor's personnel. Equipment shall be readily available for use on the proposed work. County shall not be charged for any downtime of equipment due to equipment breakdown. ii. Warranty and Repairs: Contractor shall provide all warranty work and cover all repairs except those caused by negligence, vandalism, or lack of regular preventive maintenance by the County for the duration of the guarantee period. iii. Time Limits and Constraints: Contractor shall submit with their bid a descriptive list of identified equipment for use with this contract, including type of equipment, manufacturer, capacity, ownership, hours and condition. iv. Fuel and Escalation: Contractor shall provide routine consumables (i.e.: grease, oil and fuel). No additional payment is allowed for petroleum cost escalation. v. Availability: This equipment shall be readily available for use for both regularly scheduled work and immediate emergency response. vi. Required Equipment: The following list is considered the minimum equipment list the Contractor shall provide in progression of the work tasks assigned. Contractor shall submit with his bid a list of identified equipment for use with this contract. Required Minimum Equipment 1. 3.1a Track Excavators with Thumb/Hammer (min 20 Ton) 2. 3.1b Track-Type Dozer - with general purpose blade (min 75 HP) 3. 3.1c Tractor Backhoe / Loader (min 75 HP) 4. 3.1d Hydraulic Cranes - 35 Ton thru 200 Ton 5. 3.1e Hydraulic Truck Crane (min 75 Ton) 6. 3.1f Hydraulic Truck Crane (min 160 Ton) 7. 3.1g Rough Terrain Hydraulic Crane (min 70 Ton) 8. 3.1h Motor Grader (min 200 HP) 9. 3.1i Skid Steer (min 75 HP) 10. 3.1j 4 WD Wheel Loader (min 4.75 CY) 11. 3.1k Dump Truck (min 14 CY) vii. Standby Equipment: The following equipment list is considered desirable for progression of the work tasks assigned. Contractor shall submit with his bid a list of identified and other supplemental equipment available for use with this contract. Additional Fleet Equipment: Contractor may list additional heavy highway equipment which is available for use with this contract, for the consideration of the Owner Service-Disabled Veteran-Owned Set Aside: No Contract term: 1 year w/option to extend 1 year
