City of Pflugerville Wilbarger Creek RWWTF Potable Water Meter Equipment Pre-Purchase which consists of supplying material for others to install a potable water meter for the Wilbarger Creek RWWTF Phase 1 Construction project. Proposals must be submitted on the Proposal and Proposal Schedule forms provided and uploaded to portal and must be accompanied by a bid security in a penal sum of not less than five percent (5%) of the total amount of the proposal submittal. The security may be in the form of a certified check, cashier's check or bid bond furnished by a reliable surety company having authority under the laws of Texas to write surety bonds in the amount required, with such security made payable without recourse to the City. The final Notice of Award of Contract shall be issued to the successful offeror by the City within sixty (60) days following the opening of proposals and no offeror may withdraw a proposal within sixty (60) days after opening thereof. The successful offeror must furnish a performance bond and payment bond on the forms provided, each in the amount of one hundred percent (100%) of the contract amount, from a surety company authorized by the State of Texas to act as surety. All questions from Offerors must be posted on portal. The deadline for Offeror questions will be 5:00 pm on February 20 th, 2023. Any questions posted after this date and time will not be answered. Award of this contract is contingent upon release of funds from the Texas Water Development Board's (TWDB's) Clean Water State Revolving Fund (CWSRF) and potentially the United States Environmental Protection Agency's (EPA's) Water Infrastructure Finance and Innovation Act (WIFIA) Program. Any contract awarded under this invitation for proposals is expected to be funded in part by financial assistance from the TWDB and the EPA. Neither the U.S. Environmental Protection Agency (EPA) or the State of Texas, nor any of its departments, agencies, or employees are or will be a party to this Invitation or any resulting contract. Any contract awarded under this solicitation is subject to the American Iron and Steel (AIS) requirements of federal law, the Department of Labor (DOL) Equal Opportunity in Employment requirements and the Davis-Bacon Wage Rate requirements as listed below. EPA DBE - This contract is subject to the EPA's Disadvantaged Business Enterprise (DBE) Program, which includes EPA-approved fair share goals toward procurement of Minority and Women-owned Business Enterprise (M/WBE) businesses. EPA rules require that applicants and prime contractors make a good faith effort to award a fair share of contracts, subcontracts, and procurements to M/WBEs through demonstration of the six affirmative steps. AIS - Any contract(s) awarded under this Invitation for Proposals is/are subject to the American Iron and Steel (AIS) requirements of Section 608 of the Federal Water Pollution Control Act. Offerors on this work will be required to comply with the Department of Labor regulations at 41 CFR Part 60-4, relating to Construction Contractors--Affirmative Action Requirements, which include the President's Executive Order No. 11246, as amended by Executive Order No. 11375 and Executive Order No. 13672, in the award and administration of contracts awarded under TWDB/EPA financial assistance agreements. Failure by the Contractor to carry out these requirements is a material breach, which may result in the termination of the awarded financial assistance. Davis-Bacon prevailing wage requirements apply to a construction project financed, in whole or in part, from the CWSRF and the WIFIA Program. The Davis-Bacon prevailing wage requirements apply to Contractors and Subcontractors performing on federally funded or assisted contracts in excess of $2,000 for a construction project under the CWSRF and/or WIFIA Program. For prime contracts in excess of $100,000, Contractors and Subcontractors must also, under the provisions of the Contract Work Hours and Safety Standards Act, as amended, pay laborers and mechanics, including guards and watchmen, at least one and one-half times their regular rate of pay for all hours worked over 40 in a workweek. The Fair Labor Standards Act may also apply to Davis-Bacon covered contracts. For additional information on Davis-Bacon Wage Rate Requirements and its applicability to this contract, please consult TWDB Guidance No. DB-0156. U.S. Department Labor (DOL) Wage Determination - According to TWDB-0551, the City must amend the solicitation if the DOL issues a modification more than 10 days prior to the closing date (i.e., proposal opening) for the solicitation. If DOL modifies or supersedes the applicable wage determination less than 10 days prior to the closing date, the City may request a finding from TWDB that there is not reasonable time to notify interested Contractors of the modification of the wage determination. Detailed program requirements for the TWDB's CWSRF Program and the EPA's WIFIA Program are included in the attached guidance documents: TWDB-0551, Supplemental Contract Conditions for the CWSRF (Non-Equivalency) and Document A, WIFIA Supplemental Instructions from the WIFIA Program's Borrower Guide to Federal Requirements. State statutes, including prevailing wage and hour provisions and contract regulations must be adhered to as they relate to this Project. Contractors will be required to comply with all applicable Equal Employment Opportunity laws and regulations. The City of Pflugerville reserves the rights to reject any and all proposals and to waive any informalities in proposals received; to eliminate a portion of the work or add additional work as required to keep the total contract amount within the funds budgeted; the right to award any parts or combination of parts of the project it deems necessary; and any other rights established under the laws of the State of Texas.
