Sealed Proposals will be received by the Energy Savings Company (ESCO) DCO Energy and the Owner, Eatontown Board of Education, for the Boiler Replacement at Vetter Elementary School located in Eatontown, New Jersey. Any questions or requests for clarifications shall be submitted in writing to the Architect's office no later than noon February 10, 2023 by emailing Cory Wilkerson, cwilkerson@ssparchitects.com with a copy to Lori Youngclaus, School Business Administrator at lyoungclaus@eatontown.org. The ESCO, Owner and Architect have determined that only DPMC Trade Classifications listed below are deemed eligible to bid this project. C032 HVACR Each bidder must deposit with his Bid, security in the amount of not less than 5% of the Entire Bid, in the form of a certified check or standard bid bond and subject to the conditions provided in Section B: "Instructions to Bidders". Bidders are required to comply with the requirements of Chapter 127, P.L. 1975 (NJAC 17:27 Public Contracts Affirmative Action Statute) as amended from time to time, Prevailing Wage Law (NJSA 34:11-56.25 et seq.-NJAC 12:60), the American with Disabilities Act, UGG 200.326, and with any and all other Federal and New Jersey Statutes not specified herein. The Owner and Esco Reserve the Right to Reject Any or All Bids and Waive Any Informality in the Bidding Process in Accordance With the Law if It is in the Best Interest of Both. The Contract, if Awarded, Shall Be Awarded by the Esco With Review and Approval From The Board of Education to the Lowest Responsible Bidder Whose Bid is Responsive in All Material Respects to the Bid Requirements. No Bid Shall Be Deemed Accepted Until the Execution of a Subcontract by the Esco.
