125 Live Fitup All bids shall be made on proposal forms prepared by the City and shall follow the City's bidding requirements as defined in the bidding documents. No oral, facsimile, telegraphic or telephonic proposals or modifications will be considered. Bid security in the form of a bid bond shall be submitted with each bid in the amount of five percent (5%) of the bid amount. No bids may be withdrawn for a period of 60 days after opening of bids. Owner reserves the right to reject all bids and to waive informalities and irregularities. Payment and Performance Bonds in an amount equal to 100% of Contract amount are not required as a condition of award but ARE required as a Condition of Contract. Other insurances are required as identified by the specifications. Personal bonds will not be accepted The City of Rochester is exempt from paying sales tax provided the materials are purchased under a separate contract with the contractor acting as a Purchasing Agent of the Owner. The City of Rochester is requesting separate bids for Material and Labor under one submitted bid for this reason, and a Purchasing Agent Agreement will be required. The City intends to award two separate contracts, one for material and one for labor subject to the terms of this solicitation, to the Contractor whose bid is qualified and responsive, The Owner reserves the right to accept any bid or reject any non-responsive bids. The Owner shall have the right to waive informalities or irregularities in a proposal received and to accept the proposal which, in the Owner's judgment, is in the Owner's own best interest. The City of Rochester reserves the right to reject any and all bids.
