EDA Project No. 01-79-15227 Griffiss Local Development Corporation ("Owner") is requesting Bids for the construction of the following Project: GLDC HEATING CONVERSION PROJECT, CONTRACT NO. 1. Generally, the Project consists of the work necessary to install natural gas fired boilers in Building Nos. 770, 774, 776, 778, 780, 796/798 and the AIS Building in the Griffiss Business and Technology Park, Rome, New York (collectively, the "Subject Buildings"), and related work. Bid Bond Each Bidder shall be required to furnish a Bid Bond in an amount equal to five percent (5%) of its Bid Price. Bid Acceptance Period; Withdrawal/Modification of Bid Bids shall remain subject to acceptance for fourteen (14) days after the Bid opening, or for such longer period of time that Bidder may agree to in writing upon request of Owner. Except as may be expressly set forth in the Bidding Documents no Bidder may modify or withdraw its Bid. Instructions to Bidders. For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders which are included in the Bidding Documents. Payment and Performance Bonds The Contractor shall be required to furnish a payment bond and a performance bond, each in an amount equal to one hundred percent (100%) of the Contract Price. Utilization of Local Work Forces To the greatest extent practicable, the Contractor is encouraged to utilize local work forces in the performance of the Work. Due to the nature of the Project, the Work cannot commence until (a) Griffiss Utility Services Corporation ("GUSC") shuts down the Griffiss Steam Plant in the Spring of 2023 (the "Spring 2023 Plant Shutdown") and (b) National Grid commits to Owner to commence and complete a separate project consisting of the extension of any gas mains required to service the Subject Buildings (the "Separate Project") by Fall of 2023 (or authorizes Owner to undertake and complete such Separate Project). Once the Work commences, it must be substantially completed before GUSC turns on the Griffiss Steam Plant in the Fall of 2023 (the "Fall 2023 Plant Activation"). At present, Owner anticipates that the Spring 2023 Plant Shutdown will occur on or about April 3, 2023 and that the Fall 2023 Plant Activation will occur on or about October 6, 2023, a period of 187 days. The Contract, and any subcontract, is subject to 31 U.S.C. 1352, regarding lobbying restrictions. The Section is explained in the common rule, 15 C.F.R. part 28 (55 FR 6736-6748, February 26, 1990). Each bidder under this Contract or subcontract is generally prohibited from using federal funds for lobbying the Executive or Legislative Branches of the Federal Government in connection with the EDA Award. Each bidder shall submit a completed Form CD-512, Certification Regarding Lobbying - Lower Tier Covered Transactions with its Bid, a copy of which is attached to the Project Manual as Exhibit C and is made a part thereof. The Contract will be subject to EDA's Affirmative Action and Equal Employment Opportunity requirements. The Notice of Requirements for Affirmative Action To Ensure Equal Employment Opportunity (Executive Order 11246 and 41 CFR Part 60-4) is attached to the Project Manual as Exhibit D and is made a part thereof. To the greatest extent practicable, the Contractor is encouraged to purchase American-made equipment and products. The Owner reserves the right to waive any informalities and to reject any and all bids.
