Supply and application of approximately 250,000 litres of liquid calcium chloride on various roads throughout the Township of Lake of Bays Solution shall contain a minimum of 35 percent by mass of pure calcium chloride and shall not contain impurities in excess of 2 percent by mass. Solution strength shall be determined at 156 Celsius and shall conform to Ontario Provincial Standard Speciation (O.P.S.S.) #2501, Nov.2001. Only products approved by Ministry of Environment and Energy for use as dust suppressants will be accepted. A copy of a valid letter of agreement from the Ministry of Environment and Energy shall be supplied with tender submission as well as M.S.D.S. sheets for product/s used. Price per litre, as applied to the road surface, shall be quoted. Application equipment shall have measuring device to measure product used and the device shall be in working order. A conversion factor of 1.35 kg. per litre shall be used in converting the volume of solution to equivalent mass of solution. Price to include fuel surcharge if applicable. All operations will conform to all Provincial, Federal and other Acts pertaining to work being performed. The solution shall be applied by a tandem distributor loaded from a trailer tanker on site. All operations will be performed with promptness, efficiency and in a manner satisfactory to the Supervisor of Public Works. Approximately 60 hours is required to perform said work. Additional orders may be made periodically throughout the term of this contract. The initial application shall be completed by the end of June of each contract year. Material shall conform to Ontario Provincial Standards Specifications (O.P.S.S.)2501. LIQUIDATED DAMAGES Item Condition Liquidated Damages Supply of Equipment Failure to supply the specified equipment and information, at the specified location. Unless otherwise approved by the Municipality $250.00 per day for each day (maximum 4 days) that the equipment is not provided as specified. Termination of the contract on the 6th day Staff Failure to provide proper notification to $100.00 per incident. the Owner when introducing new qualified operators Patrol Yard Failure to keep assigned work area in the yards clean (spills etc.) $100.00 per incident plus clean up expenses Safety Failure to provide Contractor's staff with $200.00 per incident. the requirements of O.H.S.A. or the work plan. Municipal Standards Failure to follow instructions as directed by the Superintendent of Public Works or designate. $200.00 per incident. Completion Date Failure to complete assigned work as per completion date herein.
