All bid guarantees shall be accompanied by an executed consent from an approved surety licensed to conduct business in the State of New Jersey, agreeing to furnish the required Performance Bond upon the award of contract. Bidders and their subcontractors shall be pre-qualified by the Department of Treasury, Division of Property Management and Construction with a minimum classification of C021. Furthermore, asbestos removal contractors must have a minimum classification of C092 and hazardous abatement contractors must have a minimum classification of C094. The Bidder and its subcontractors must submit an affidavit with its bid setting forth the type and amount of work for which it has been qualified, that there has been no material adverse change in its qualification information, and the total amount of uncompleted contracts at the time of bid and date of classification. No bid may be withdrawn for a period of sixty (60) days after the date set for the opening thereof. Bidders are required to comply with the affirmative action and non-discrimination provisions of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1.1 et seq. and, where applicable, the requirements of N.J.S.A. 34:11-56.25 et seq. and N.J.S.A. 40:37A-55 et seq. with respect to the payment of prevailing wages.
