Bids must be submitted in the form prescribed by the Contract Documents within a sealed envelope showing the Bidder's name and clearly marked: [FISHKILL PLAINS WATER DISTRICT WELL 1 & WELL 2 REHABILITATION] CONTRACT WS2023.03 Each Bidder must furnish, with his Bid, Bid Security in the amount of not less than five percent (5%) of the amount bid. This security may be in the form of a certified check payable to the "Town of East Fishkill", a bid bond, or cash. In addition, each Bid must be accompanied by a properly executed non-collusion affidavit. No Bidder may withdraw his Bid within sixty (60) days of the bid opening. This Contract is subject to the prevailing wage determination made by the New York State Department of Labor. The Town of East Fishkill reserves the right to reject any and all bids, to waive any informalities therein, or to award the Contract to any Bidder if deemed to be in the best interest of the Town to do so. ALL WORK SHALL BE COMPLETED FOURTY (40) CALENDAR DAYS FROM NOTICE TO PROCEED. Failure to complete all work by this date will result in Liquidated Damages in the amount of $250 per day being assessed to the Contractor. The Contractor shall not receive any additional compensation for completing work prior to Time of Completion.
