Work to be performed shall include furnishing all labor, equipment and materials for the resurfacing/improvement of streets, and all other work shown and specified in the Contract Documents. The sites of construction are various sections of street within the Town of Westville, Indiana. NOTE: Specifications and Bidding Documents obtained from any other source will deem the Bid Non-Responsive, and thus ineligible for award of a Contract. Bids must be on the Bid Form contained in the Specifications. Each bidder must also complete a Form 96 (as prescribed by the State Board of Accounts); an executed non-collusion affidavit; signed copies of addenda (if issued); a completely executed Affidavit of Compliance with Indiana Immigration Law and Certification of Not Being Engaged in Investment Activities in Iran (copy attached); bid submission documents as required by the Town of Westville Responsible Bidder Ordinance; and satisfactory bid security as set forth in the Contract Documents. All bids must be accompanied by a certified check or bid bond in the amount of 5% of the Bid. The contract for the project will be awarded in accordance with the provisions of IC 5-16-13. Pursuant to IC 5- 1613-7, the provisions of the law are incorporated by reference into each public works contract and each bidder agrees that pursuant to IC 5-16-13-8 the public works project will not be structured other than in the contractor tier structure required by law. All bidders shall be required to comply in all respects with the provisions of IC 5-16-13 including, but not limited to, offering training programs, document preservation, and availability of inspection and suspected worker misclassification procedures. The provisions pursuant to IC 5-16- 13-10(c) include requirements for prequalification by the Indiana Department of Administration. No bidder may withdraw his bid within 60 days after the actual date of the opening thereof. The Town of Westville, Town Council reserves the right to reject any or all bids, or to accept a full or partial award of the bid, which, in its judgment, will be to the best interests of the Town of Westville, Indiana.
