Proposal shall be accompanied by a certified check drawn on a bank or trust company insured by the Federal Deposit Insurance Corporation, of an amount equal to not less than five percent (5%) of the bid executed by a surety company licensed under the laws of North Carolina to execute such bonds, conditioned that the surety will, upon demand forthwith make payment to the oblige upon said bond if the bidder fails to execute the contract in accordance with the bid bond. Said deposit shall be retained by the owner as liquidated damages in the event of failure of the successful bidder to execute the contract within fifteen days after award. A Performance Bond and a Payment Bond will be required for one hundred (100%) of the contract price. No bid may be withdrawn after the bid opening of bids for a period of 30 days. The Owner reserves the right to reject any or all bids and waive informalities. Payment will be made lump sum within 30 days after acceptance of the work. Proposals shall be made only on the form provided herein with all blank spaces for bids properly filled in, confirmation of all addenda issued, and all signatures properly executed. Bids (with 5% deposit or Bid Bond) shall be sealed in an opaque envelope marked "Proposal", followed by the Project Title, Bidders name and address, and North Carolina license number.
