If the Contractor is unable to achieve the DBE goal using race neutral methods, it is appropriate to utilize race conscious measures to achieve the goal. If the Contractor is unable to meet the DBE goal, a Good Faith Effort in accordance with 49 CFR Part 26, Appendix A is required. The Biddeford Airport Commission reserves the right to reject any and all Bids, to waive any technical or legal deficiencies, and to accept any Bid that it may deem to be in the best interest of the City of Biddeford. No Bidder may withdraw their Bid for a period of 180 days following the Bid opening. Award of Contract is contingent upon receipt of funding from Federal and State sources.
