On contracts of one hundred fifty thousand dollars ($150,000.00) or less, at Contractors option the requirement may be waived in lieu of an additional 5% (total 10%) retainage. Liquidated Damages: Timely performance and completion of the Work is essential to Owner and time limits stated in the Contract Documents are of the essence. If Completion of the Work does not occur within the Contract Time, the Contractor agrees that Liquidated Damages in the amount of $250.00 per day will be assessed for each calendar day that the Contractor exceeds the time for completion.
