Dredge approximately cubic yards 1,800 (CY) by bucket to barge system from the Salters Creek Boat Access Area Channel as shown in the construction drawings. The dredge spoil material shall be placed within the proposed material disposal site located by the Contractor Executed contract documents, insurance certifications and, upon completion and acceptance of the work, invoices and other information requested are to be sent to: Eugene Foxworth Assistant County Manager Carteret County Administration Building 210 Turner St. Beaufort, NC 28516 Where items of equipment or material carry a manufacturer's warranty for any period in excess of twelve (12) months, then the manufacturer's warranty shall apply for that particular piece of equipment or material. The contractor shall replace such defective equipment tor materials, without cost to the owner, within the manufacturer's warranty period. The Contractor shall commence work under this Contract on a date to be specified in written order from the County and shall fully complete all work as follows: Complete all in-water dredging activities by March 31, 2023. Complete all work items (FINAL COMPLETION) as agreed to by the Disposal Site owner. Contractor and Owner recognize that time is of the essence and that Owner will suffer financial loss if the Work is not completed within the times specified above, plus any extension thereof allowed in accordance with the Contract Documents. The parties also recognize the delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the Works is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but no as a penalty), in the event the Contractor does not complete at least the work, in the time allotted under TIME OF COMPLETION above, the Contractor shall pay a sum of $1,000 / day for each day the work continues until finished. Liquidated damages shall only apply to the in water dredging activities (work). A performance and payment bond are required.
