Reference Number 0000241981 Agreement Types Canadian Free Trade Agreement (CFTA) New West Partnership Trade Agreement (NWPTA) The Work to be done under the Contract shall consist of all that is required for the permanent and temporary restoration of hard surface utility cuts for the City of Winnipeg Water & Waste Department (W&W). The Work shall be completed in accordance with the latest versions of all manuals and specifications listed in E1, and any other applicable standards, on behalf of the W&W Department for a period of one (1) year from date of the award of contract until June 14th, 2024 with four (4) mutually agreed upon one (1) year extensions. D2.1.1 The City may negotiate the extension option with the Contractor within ninety (90) Calendar Days prior to the expiry date of the Contract. The City shall incur no liability to the Contractor as a result of such negotiations. D2.1.2 Changes resulting from such negotiations shall become effective on June 15th of the respective year. Changes to the Contract shall not be implemented by the Contractor without written approval by the Contract Administrator. D2.1.3 Bidders are advised that, in future, the City may be participating in collaborative procurement initiatives with other levels of government. Accordingly, extensions to this Contract may not be exercised. D2.2 The major components of the Work are as follows: (a) Full depth reinforced concrete restorations; (b) Pavement restorations; (c) Sidewalk restorations; (d) Concrete curb restorations; (e) Placement of temporary restorations which would include steel plates or Winter Capping Material as required; (f) Removal of temporary restorations; (g) Disposal of waste materials. D2.3 The Work shall be done on an "as required" basis during the term of the Contract. D2.3.1 The type and quantity of Work to be performed under this Contract shall be as authorized from time to time by the Contract Administrator and/or Users. D2.3.2 Notwithstanding C7.4, the City shall have no obligation under the Contract to purchase any quantity of any item in excess of its actual operational requirements. D2.4 The Work will be provided to three (3) groups within W&W - Water Services, Wastewater Services, and Customer Technical Services. (a) Each group will provide their own W&W Representative to communicate with the Contractor. (b) The Contractor will submit separate invoices to each group in accordance with section D26. D2.5 Below are the estimated number of cut repair sites for W&W, based on historical data. Actual requirements may vary: (a) Water Services - 700 to 1100 cut restorations per year (b) Wastewater Services - 200 to 300 cut restorations per year (c) Customer Technical Services - 100 to 150 cut restorations per year D2.6 A W&W Representative will notify the Contractor via email when a utility cut is ready for restoration. Upon this notification, responsibility for the site is thereby transferred to the Contractor, and the Contractor assumes the role of Prime Contractor. (a) The Contractor will assume full responsibility for the Site, including work processes, traffic control, road closures, safety, signage, re-opening of the site, and all other associated costs and requirements, until the restoration site has reached Total Performance as described in D16. (b) The Contractor shall do all things necessary to maintain and manage the site in accordance with City requirements and expedite completion of the Work. D2.7 The Site will be transferred to the Contractor as described in D2.6 in the following condition: (a) There will be a rough cut of the hard surface sufficient to complete the underground repair. (b) City crews will backfill and pavement cut locations to within 1 metre of bottom of pavement. The Contractor can expect to complete final base preparation and site preparation prior to pavement installation, which may include compaction of sub-base, removal of frozen material, and filling adjacent voids with Winter Capping Material. (c) City Traffic Control Devices will be in place. (i) City Traffic Control Devices will be replaced by the Contractor as described in D2.8. D2.8 Within 24 hours for Regional Streets, and 72 hours for Non-Regional Streets, the Contractor shall replace all City Traffic Control Devices with their own traffic control devices. The Contractor is to stockpile the City Traffic Control Devices at a suitable location near the worksite, and immediately notify the W&W Representative that the traffic control devices are ready for pick up. D2.9 The Contractor shall, at their expense, supply, erect, maintain, modify, and remove applicable traffic control devices and barricades, provide flag persons, and follow traffic control procedures in accordance with the Manual of Temporary Traffic Control in Work area for the duration of the Work. D2.10 All pavements to be restored must be saw cut full-depth in accordance with the City of Winnipeg Public Works Street Cuts Manual. No separate payment will be made for the saw cutting of pavements. D2.11 Top soil and seed shall be placed in gaps along concrete edges and shall be considered incidental to the contract. D2.12 The construction of isolations shall be considered incidental to the contract. D2.13 Removal of existing material shall be considered incidental to the contract. D2.14 All cut permits will be obtained and paid for by the City. For each site, the W&W Representative will provide the Contractor with the permit number, location, scope of work, and approximate restoration size. If the Contractor disagrees with the information provided, they are to contact the W&W Representative before proceeding with the Work. D2.15 The Contractor shall provide a single point of contact for all communication with the W&W Department. Any changes to the Work are to be confirmed by email. D2.16 Permanent restorations are to be completed during the Permanent Restoration Window. The exact dates for the Permanent Restoration Window will be determined and communicated seasonally by the City Public Works Department. D2.17 Temporary pavement restorations will be required outside the Permanent Restoration Window. It will be the responsibility of the Contractor to regularly inspect and maintain these temporary restorations at their own cost until they are permanently restored. (a) The Contractor may submit invoices for these restorations in accordance with unit pricing provided on Form B and D23. D2.18 Temporary pavement restorations will not be required during the Permanent Restoration Window. Any temporary restorations completed during this time will be at the Contractor's expense, unless requested by a W&W Representative by email. D2.19 The amount of Work will fluctuate throughout the year. The Contractor must have the necessary resources (i.e. labour, equipment, materials) to adjust to the amount of Work. D2.20 Any additional costs incurred by the City as a result of a lack of site maintenance or by-law violation will be the responsibility of the Contractor. D2.21 The Contractor is responsible for any additional fees, fines, or costs that they incur associated with the Work. D2.22 The Contractor is responsible for all costs associated with Warranty work applicable to the Work. D2.23 The Contractor shall be responsible to request and obtain all additional utility clearances and lane closures, as required. D2.24 The Contractor is to act as an advocate for the Water & Waste Department, ensuring that restoration costs are minimized. D2.25 The Contractor shall be available to work 7 days a week including holidays, if required, to ensure compliance with City requirements. D2.26 Under exceptional circumstances, the City may allow property owners to self-restore private property. At these sites, the Contractor will only be reimbursed for Work completed on behalf of the City. D2.27 The City may introduce new repair techniques or requirements. The Contractor is to accept and utilize these as requested. D2.28 The Contractor will respond to phone requests within a half (1/2) working day.
