For a bid to be accepted, Bidders must be prequalified prior to bidding by the School District of Philadelphia in accordance with Paragraph 4 of the Instructions to Bidders. Each Proposal shall be accompanied by either a certified check or a surety company's bid bond, in an amount of not less than 10% of the Proposal amount, which check or bond shall be payable to The School District of Philadelphia as payee or obligee. (BID PROCESSING FEE WAIVED FOR THIS PROJECT) NOTE: ALL INQUIRIES (RFIS) REGARDING THE DRAWINGS AND SPECIFICATIONS MUST BE SUBMITTED IN WRITING TO Eric Jenkins (ejenkins2@philasd.org) NO LATER THAN TEN (10) CALENDAR DAYS PRIOR TO THE SCHEDULED BID OPENING PRE-BID CONFERENCE/SITE TOUR A. Bidders are responsible to visit the Project site and familiarize themselves with the site conditions B. A Pre-Bid Conference and Tour of the existing facilities may be scheduled for this Project at a time and place specified in the Invitation to Bid C. Attendance at the Pre-Bid Conference and Tour is strongly recommended for any Bidder submitting a Proposal. BID SECURITY 1. Each Bid shall be accompanied by a bid security pledging that the Bidder will enter into a Contract with the School District and on the terms stated in the Bid and will furnish bonds covering the faithful performance of the Contract and payment of all obligations arising thereunder. Should the Bidder refuse to enter into such Contract or fail to furnish such bonds, the amount of the bid security shall be forfeited to the School District as liquidated damages, not as a penalty. 2. Bid Security shall be made payable to The School District of Philadelphia in the amount of ten percent (10%) of the Proposal including all additive Alternates Proposal amounts. 3. A certified and current copy of the Power of Attorney of the attorney-in-fact who executes the bond on behalf of the surety shall be affixed to the bond. 4. Bid Security shall be a certified check or bid bond issued by a surety company legally authorized to do business as a surety in the Commonwealth of Pennsylvania. Corporate sureties must appear on the current list in Treasury Circular 570 and the current Commonwealth of Pennsylvania Insurance Department Surety List, and the amount of the bid bond may not exceed the underwriting limit stated for the surety on these lists. 5. The bid bond shall be identical to the form included with the Bidding Documents, and any other form of bonds shall be rejected by the School District. 6. The Bidder shall furnish Bid security, including a Bid Bond or a certified check, that is acceptable to and approved by the School District; or the Bid of the Bidder shall be deemed to be "non-responsive". 7. The School District will have the right to retain the bid security of Bidders to whom an award is being considered until the later of the date on which (a) the Contract has been executed and bonds have been furnished, or (b) the specified time has elapsed so that Bids may be withdrawn, or (c) all Bids have been rejected.
