The Middlesex County Utilities Authority (the "MCUA") is soliciting competitive contracting proposals in response to this Request for Proposals ("RFP") from qualified vendors ("Proposers") to enter into a Power Purchase Agreement (PPA) to provide photovoltaic system installation and associated improvements, as more fully described in the RFP. Any questions regarding this RFP should be directed in writing to Casey Furey, Project Manager, at cfurey@mcua.com. Proposals must be made in accordance with the requirements of the RFP and must be enclosed in sealed envelopes bearing the name of the procurement and the name and address of the Proposer on the outside, addressed to the MCUA. Proposals may be hand delivered or mailed by certified mail to the above-mentioned address. The MCUA has no responsibility for any Proposal that does not arrive at the MCUA by 2:00 p.m. on April 4, 2023. Proposals to this RFP are being solicited through a competitive contracting process in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-4.1 et seq. The RFP requires Proposers, and as applicable, their subcontractors, to adhere to the requirements applicable to public works contracts such as the Prevailing Wage Act (N.J.S.A. 34:11-56.25 et seq.) as applicable; the Public Works Contractor Registration Act (N.J.S.A. 34:11-56.48 et seq.); the Business Registration Act (N.J.S.A. 52:32-44); the Equal Employment Opportunity Laws and Regulations, (N.J.S.A. 10:2-1 et seq., N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-3.7 and 3.8), the Americans With Disabilities Act (42 U.S.C. 12101); the New Jersey Local Unit Pay-to-Play Law (N.J.S.A. 19:44A-20.4 et seq.); and, the New Jersey Campaign Contributions and Expenditure Reporting Act (N.J.S.A. 19:44A-1 et seq.). The MCUA reserves its right to reject all Proposals and determine that it will not award a contract in response to the RFP, in accordance with applicable law.
