Renovation of a water / sewer project in Denver, Pennsylvania. Completed plans call for the renovation of a water / sewer project.

The project generally consists of the installation of three (3) new raw sewage pumps and a new triplex pump control panel at the Adamstown Borough Wastewater Treatment Plant as specified and indicated on the Contract Drawings. CLARIFICATION DEADLINE 3/31/2023 12:00 PM All bidders must submit bid security in the amount of ten percent [10%]. All Contracts exceeding $10,000.00 shall be performed in compliance with Executive Order 11246, entitled, "Equal Employment Opportunity," as amended by Executive Order 11375 and as supplemented in Department of Labor regulations (41 CFR Part 60). In addition, all Contractors shall comply with the "Nondiscrimination/Sexual Harassment Clause" as required by Pennsylvania Executive Order 2016-05. Performance financial security and payment financial security, each in an amount equal to 100% of the contract price in form set forth in the Project Manual, and evidence of all required insurance as set forth in the Bidding Documents, must be furnished by the successful Bidder at the time set forth in the project manual. In the event that the successful Bidder proposes to furnish a lending institution letter of credit or a restrictive lending institution escrow account as performance and payment financial security rather than performance and payment surety bonds, the form and content of such alternative financial security must be in compliance with Pennsylvania law, fully protect the public and be approved by the Owner's solicitor. Bidders are advised that each Bidder is required to submit, with their Bid, a Non- Collusion Affidavit in the form contained in the bidding documents in accordance with the Pennsylvania Anti-Bid Rigging Act. The wages paid on this project will be subject to the Pennsylvania Prevailing Wage Act approved August 15, 1961, P.L. 987 as amended and supplemented. The Pennsylvania Human Relations Act of 1955, P.L. 744, No. 222, as amended June 25, 1997, by Act 34 of 1997, 43 P.S. 951-963, shall apply to this contract. Attention is called to the fact that not less than the minimum salaries and wages as set forth in the contract documents must be paid on this project, and that employees and applicants for employment shall not be discriminated against because of their race, age, color, religion, sex, national origin, or handicap. The Bidder and all subcontractors must be qualified for the type of project work specified in order to bid the project, and prequalification's must be submitted by the Bidder and all subcontractors. The qualification documentation listed in Article 3 in the Instructions to Bidders must be submitted with the bid Bidders should refer to provisions of federal and state statutes, rules and regulations dealing with prevention of environmental pollution and the preservation of public, natural resources that affect the project. Any Bid received after the time and date specified shall not be considered. Owner shall award the Contract to the lowest responsive and responsible Bidder or shall reject all Bids within sixty (60) days of the date of the bid opening, and no Bidder may withdraw his Bid before the expiration of such sixty (60) day period; provided, however, if the award of contracts is delayed by required approval of another government agency, the sale of bonds or the award of a grant or grants, the Owner shall reject all bids or award the Contract to the lowest responsive and responsible Bidder within one hundred twenty (120) days of the date of Bid opening, and in such event no Bidder may withdraw his Bid before the expiration of such one hundred twenty (120) day period. Extensions of the date for the award of the Contract may be made by the mutual written consent of the Owner and the lowest responsive and responsible Bidder. The Owner reserves the right, at its option, to waive any informalities, irregularities, defects, errors or omissions in any or all proposals and to reject any or all proposals. Any BID may be withdrawn prior to the above scheduled time for the opening of BIDS or authorized postponement thereof.
