Site work, paving and outdoor lighting for a mixed-use development in Elizabeth, New Jersey. Completed plans call for site work for a sidewalk / parking lot; for outdoor lighting for a sidewalk / parking lot; for paving for a sidewalk / parking lot; and water / sewer project.

**As of May 03, 2023, project was awarded to Diaco Contracting, Inc., d/b/a Grade Construction, awarded amount is $2,950,091.04.** For the following project: ELIZABETH RIVER TRAIL - PHASE IV, CONTRACT 01-23 CITY OF ELIZABETH, UNION COUNTY, NEW JERSEY The project generally consists of the construction of a 10-foot wide shared use path, construction of cast in place concrete retaining walls, replacement of the existing metal railing on the existing bulkhead, installation of rectangular rapid flash beacons, public sidewalk curb ramps, signs, striping, lighting, landscaping and restoration. This project is federally funded with H.U.D. Community Development Block Grant Disaster Recovery Funds and Administered by the New Jersey Economic Development Authority. The provisions of the federal government Department of Labor's current wage rate determinations and the New Jersey Prevailing Wage Act are requirements of this project. The higher of the federal or state wage rate and the higher of the federal or state fringe benefit rate shall prevail. Successful bidder must comply with all Federal and State requirements contained in the project specifications and have a valid Unique Entity ID (formerly DUNS number) and active sam.gov account. All questions must be in writing email to the Engineer, CME Associates at goliva@cmeusa1.com. Each bid must be accompanied by a certified check, cashier check or surety bond of a corporation acceptable to the City and in the amount of ten percent (10%) of the total amount of the bid presented, but in no case in excess of $20,000.00. Each bidder must also submit with his bid a certificate from a responsible surety company stating that the said surety company will provide in the event that he should be the successful bidder, surety bond(s) in the amount of one hundred percent (100%) of the contracted price and subject to such conditions as contained in the specifications. Bidders shall furnish one (1) original of their proposal. Any award with respect to this matter is specifically contingent upon the availability of sufficient funds having been appropriated in the municipal budget. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq., N.J.S.A. 40A:11-21, N.J.S.A. 40A:11-22, N.J.S.A. 40A:11-23.1, N.J.S.A. 40A:11-23.2, N.J.S.A. 34:11-56.48 et seq., as well as the requirements of N.J.S.A. 52:25-24.2 of the State of New Jersey as amended, N.J.S.A. 52:25-24.2 of the State of New Jersey as amended, as well as the requirements of P.L. 1963. C150 (New Jersey Prevailing Wage Act), Section 3 of the Housing and Urban Act of 1968, as amended (HUD 24 CFR Part 135) and Americans with Disabilities Act of 1990 (42 U.S.C. 12101, et.seq.). Attention of bidder is particularly called to the requirements of Chapter 2.92 (formerly Chapter 65) of the City of Elizabeth as supplemented and amended which requires the submission of certain affidavits which shall be considered by the City, in its determination of the responsibility of the lowest bidder. The City specifically reserves the right to waive any bidding irregularities with regard to the bidding requirements and as determined by City Council to be immaterial. The award or rejection of a contract for the within project is subject to the time limitations set forth in N.J.S.A. 40:11-24, except that the bids of any bidders who consent thereto may, at the request of the contracting unit, be held for consideration for such longer period as may be agreed. The successful bidder will be required to furnish the required bond(s) and certificates of insurance and to execute the contract within ten (10) calendar days from the award of the contract. Construction must begin within ten (10) calendar days after written notice to do so shall have been given to the Contractor by the Director of Public Works, and shall be carried on regularly and uninterruptedly, at a rate to insure its full completion within the specified calendar days after such notice. If at the time of award of the contract, the successful bidder has one or more contracts for projects with the City or is subsequently awarded a contract for other projects with the City than it will be required to work concurrently on all projects without interruption or delays. City Council reserves the right to reject all bids or any part thereof or to award to the lowest responsible and responsive bidder, in accordance with applicable law.
