Stafford County Public Schools reserves the right to reject any or all Bids and to waive any informalities in the bidding. Stafford Schools does not discriminate against an offeror because of race, religion, color, sex, national origin, age, disability, or any other basis prohibited by state law. Each Bid in excess of $100,000 must be accompanied by (1) Irrevocable Letter of Credit; or (2) a Cashier's Check or a Certified Check from the Bidder in an amount not less than five percent (5%) of the Bid, made payable to Stafford County Public Schools; or (3) a Bidder's Bond on the Bid Bond Form provided herein or on a similar form which in every respect materially complies with said Bid Bond Form, in the amount of five percent (5%) of his Bid; or (4) a cash escrow in the face amount required for by the bond with a lending institution insured by the FDIC. The Bidder's Bond shall be issued by a surety company licensed to conduct business in Virginia and acceptable to Stafford Schools. For bids exceeding $100,000, the Successful Bidder shall furnish a Performance Bond in an amount equal to one hundred percent (100%) of the Contract Sum as security for the faithful performance of this Contract, and also a Labor and Material Payment Bond in an amount not less than one hundred percent (100%) of the Contract Sum, as security for the payment of all persons performing labor and furnishing materials under this Contract.
