It is the policy of the U.S. Department of Transportation that Disadvantaged Business Enterprises (DBEs), as defined in 49 C.F.R. Part 26, are encouraged to participate in the performance of contracts financed in whole or in part with federal funds. As a condition of federal grant assistance, SacRT has adopted a DBE program for SacRT's federally-funded contracts. Consequently, the DBE requirements of 49 C.F.R. Part 26 apply to this contract. SacRT has not established an overall DBE Goal for this Work Order Contract. However, any Work Orders for projects using federal funds that result from this solicitation will incorporate by reference the requirements of 49 C.F.R. Part 26. Therefore, DBE Goals may be established on a project-by-project basis on Work Orders that are: funded with Federal assistance; that have subcontracting opportunities; and for which there is an available pool of DBEs that are certified in the NAICS codes related to the Work Order. Bidders/Proposers must ensure that DBEs have the opportunity to participate in the performance of this Contract and must take all necessary and reasonable steps to obtain DBE participation. The ability to meet an established subcontracting goal will be considered when determining which firm is most qualified. Contractor must not discriminate on the basis of race, color, national origin, sex, disability or age in the award and performance of subcontracts. Attachment 6 Disadvantaged Business Enterprise Program Contract Provisions sets out the requirements Contractor must meet for this Work Order Contract. A Bidder/Proposer must submit the following forms with its bid: o DBE Commitments Form for Work Order Contracts (DBE Form 1b) (49 CFR Section 26.55) o Confirmation by DBE (DBE Form 2) or copy of DBE's quote or Form 60 o DBE Commercially Useful Function Certification (DBE Form 3) SacRT hereby notifies all proposers it will affirmatively ensure that, in regard to any contract entered into pursuant to this solicitation, all proposers will be afforded full opportunity to submit a proposal in response to this invitation and will not be discriminated against based on race, color, creed, sex, disability, age, or national origin in consideration for an award. SacRT does not prequalify subcontractor firms. However, Prime Contractors are encouraged to review the Prospective Bidders list on PlanetBids to find interested firms for subcontracting opportunities.
