A cashier's check or bid bond payable to Huntsville City Board of Education in an amount not less than five (5) percent of the amount of the bid, but in no event more than $10,000, must accompany the bidder's proposal. Per- formance and Payment Bonds and evidence of insur- ance required in the bid doc- uments will be required at the signing of the Contract. Drawings and Specifications may be examined at the of- fice of the Architect, Ward Scott Morris Architecture, Inc., 1300 Meridian St N, Huntsville, Alabama and Datatek Reprographic Bid bonds are to be issued byan acceptable bonding company licensed to do businessin the State, with a Power ofAttorney, to confess judgment thereon, with the understanding that it shallguarantee that the biddershall not withdraw his bid forthe guarantee period of sixty(60) days after the scheduledclosing time for the receipt ofbids; that if his bid is accepted, he will enter into aformal contract with theOwner, and that in the eventof a withdrawal of said bidwithin said period, or the failure to enter into said contractwithin the time specified, thebidder shall be liable to theOwner for the full amount ofthe bid guarantee as liquidated damages and not as aforfeit or as a penalty. The bidbond and certified checks onunsuccessful bidders will bereturned upon awarding thecontract or rejection of allbids, in no event, later thanthe number of days in theguarantee period from theopening of proposals. That ofthe successful bidder will bereturned when formal contract and bonds are acceptedand approved. Bids must be submitted onproposal forms furnished bythe Architect or copiesthereof. All bidders bidding inamounts exceeding that established by the State Licensing Board for GeneralContractors must be licensedunder the provisions of Title34, Chapter 8, Code of Alabama, 1975, and must showevidence of license beforebidding or bid will not be received or considered by theArchitect; the bidder shallshow such evidence byclearly displaying his or hercurrent license number onthe outside of the sealed envelope in which the proposalis delivered. The Owner reserves the right to reject anyor all proposals and to waivetechnical errors if, in theOwner's judgment, the bestinterests of the Owner willthereby be promoted The bidder's companyemployee attending the prebid conference shall havequalifications and experiencewith the construction to beperformed within this project.Any questions concerning thepre-bid conference shall bedirected to the Architect. Nonresident bidders must accompany any written bid documents with a written opinionof an attorney at law licensedto practice law in such nonresident bidder's state ofdomicile, as to the preferences, if any or none,granted by the law of thatstate to its own business entities whose principal placesof business are in that statein the letting of any or all public contracts
