As of November 28, 2023, the project has been awarded, however, information regarding the awarded general contractor and a timeline for construction have not been confirmed at this time. SUBSTANTIAL COMPLETION DATE. The term SUBSTANTIAL COMPLETION DATE means the date after the WORK has commenced when the WORK or designed portion thereof is sufficiently completed in accordance with the CONTRACT DOCUMENTS such that the OWNER can occupy or utilize the WORK for its intended use. For purposes of this WORK, the SUBSTANTIAL COMPLETION DATE shall be no later than July 31 , 2023, subject to adjustment as provided herein. The date of commencement of the WORK shall be August 24 , 2023. The Project includes construction of a new sidewalk being tied into the existing sidewalk at the schools driveway, signal improvements, signal re-timing, roadway improvements at the intersection of Devon Drive and the Schools Driveway and other related construction. The bid will be for furnishing all labor, materials, equipment, supervision, and services associated with Downingtown East High School Devon Drive Design Project. Bids are to be submitted via PennBIDtm on the forms furnished in the bid package. Each bid shall be accompanied by a bidders bond, certified check, or cashiers check, in favor of Downingtown Area School District, in the amount of not less than 10% of the total amount of the bid. The successful bidder shall be bound to furnish and pay for a Performance Bond and a Labor & Material Payment Bond in an amount equal to one hundred percent (100%) of the contract price, on bond forms provided by Downingtown Area School District. All bidders must be PennDOT pre-qualified as either a prime or a sub-contractor to submit a bid and must complete a non-collusion affidavit. This contract is in accordance with the Pennsylvania Prevailing Wage Act, and the successful bidder shall pay no less than the Wage Rates determined for the project as stated in the Contract documents. Award of the Contract, if the contract is awarded, will be to the lowest responsible bidder, as determined by Downingtown Area School District. The Downingtown Area School District reserves the right to reject any and or all bids on any basis and to waive any defects, errors, omissions, irregularities, or informalities in the bidding, as permitted by law, and to accept any Bid which it may deem to be for or in the best interest of the Downingtown Area School District in its sole and absolute discretion. No bidder may withdraw a bid after the actual date of the opening thereof.
