Project Summary of Work Work includes the fabrication and assembly of an aluminum canopy measuring 14’x 21’. Design shall be comparable to the existing canopies for the protection of the machinery on the work platform. The contractor shall furnish all services, materials, labor, formwork, equipment, permits, supplies, supervision, and travel. The canopy will be delivered to and assembled at Robert S. Kerr Marine Terminal, 460360 E. 1137 Rd, Sallisaw, OK 74955. The contractor shall provide 48 hour notice prior to delivery. The Contractor shall be responsible for the fabrication and assembly of an aluminum canopy measuring 14’x 21’ and design be in accordance with provided drawings. The use of neoprene isolation gaskets should be utilized when dissimilar metals are adjoined. Canopy roof shall not leak and will utilize a gutter and spout system to drain water. The canopy will use four aluminum posts to anchor to the support structure and feature stainless steel lifting eyes in four locations on top. Design of the new canopy will be reviewed and approved by the Government before fabrication. The contractor will be responsible for field verifying measurements to utilize the original bolt pattern used to anchor the structure to the support beams. No electrical work required in contract. 1.2 BASIS FOR PAYMENT The payment shall be made after completion after final delivery and fabrication. Send invoice for payment to Jody Perkins, Contracting Officer Representative (COR), by email: jody.c.perkins@usace.army.mil. 1.3 WORK HOURS Regular work hours, from Monday through Friday, shall be coordinated with Jody Perkins (COR) to exclude federal holidays. Any proposed changes to the work hours must be approved by the Contracting Officer. 1.4 COMPLETION TIME The Contractor shall be required to (a) commence work under this contract within 10 calendar days after receipt of award, and complete final delivery not later than 60 days. 1.5 LIQUIDATED DAMAGES-52.211-11 Liquidated Damages-Supplies If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $510.00 for each calendar day of delay until the work is completed or accepted. If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause. 1.6 SAFETY REQUIREMENTS The contractor shall comply with the Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1 latest Edition, and all applicable Federal, State, and local safety codes and practices. Contractor shall provide to the government a detailed safety plan for accomplishment of work. The safety plan shall be approved by the government before start of work. It is the contractor’s responsibility to ensure public safety during the entire duration of the contract. Necessary signs, barriers, warning devices, etc. shall be operated and maintained by the contractor at contractor expense. Contractor employees shall comply with the minimum dress requirements as stated in Chapter 7 of EM 385-1-1. 1.7 EQUIPMENT All equipment used to perform work under this contract shall be in good operating and mechanical condition and shall comply with Section 18 of EM 385-1-1. Equipment shall be inspected by the contractor and the inspection reports shall be submitted to the Contracting Officer prior to utilization of such equipment to accomplish work on this contract. 1.8 WEATHER LIMITATIONS-52.212-4(f) Excusable Delays The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence. 1.9 SUBMITTAL DESCRIPTIONS Prior to Commencement of Fabrication, Coordinate with Contracting Officers Representative for reviews and approvals regarding Shop drawings, diagrams, instructions from a manufacturer of fabricator for use in producing the product and as aids to the Contractor for integrating the product or system into the project. 1.10 PREWORK CONFERENCE A prework conference will be held with the Contracting Officer and contractor prior to the commencement of any work. The contractor’s responsible person, necessary administrative staff, and major subcontractors will be required to attend this meeting. Procedures for proper invoicing and payment, schedule, submittals, etc., will be covered at this time. 1.11 ENVIRONMENTAL CLEANUP The contractor shall always maintain a clean work area. The contractor shall be responsible for the protection of the environment and will be required to restore all damages subject to the approval of the contracting officer. The contractor shall remove and dispose of all debris off Government property in a state approved disposal site unless specified otherwise. See contract clauses 52.204-4 and 52.223-17 PART 2 EXECUTION 2.1 CONTROL OF WATER The Contractor shall take all precautions and actions necessary to keep the work area free from surface water and seepage water until completion of work. The Contractor shall adequately protect exposed materials at the end of each workday or when rainfall is imminent. 2.2 PUBLIC SAFETY The Contractor shall perform all activities in accordance with EM 385-1-1. In addition, the Contractor's work plan, and construction methods shall be developed and executed with the understanding that public safety will not be compromised. The Contractor shall plan and execute the work to maintain public safety during both active work times and non-work times. The Contractor shall leave the work area daily in such a manner that public safety is maintained during non-work hours. 2.3 CONTRACTOR STAGING AREA The Contractor will be provided an area at the RS Kerr marine terminal for staging building materials during the assembly of the canopy, limits for staging, storage, and any other contract activities. The Contractor shall provide all necessary facilities (gates, fences, gravel, office trailers, storage buildings, fuel tanks, etc.) and utilities. The Government will provide no facilities. The Contractor shall obliterate all facilities and return all areas to pre-contract state (including grading and turfing, as applicable) before the contract is deemed by the Government to be complete. Payment may be withheld pending acceptable obliteration of these facilities. 2.4 SPECIFICATIONS The Contractor shall obtain all required information, measurements, dimensions, etc. necessary to field verify all existing conditions and dimensions and provide the specified Detailed Work Plan, and all other necessary submittal information. If there are existing conditions that appear to affect the proposed construction, the Contractor shall inform the COR in writing before proceeding with any manufacturing or construction processes, including ordering of materials. PART 3 PRODUCTS 3.1 MATERIALS AND CONSTRUCTION Work includes the fabrication and assembly of an aluminum canopy for the protection of the machinery on the work platform. The contractor shall furnish all services, materials, labor, supplies, supervision, and travel as required in connection with the fabrication of an aluminum canopy for Pier 12 at RS Kerr Lock & Dam 15 Spillway. Height: Overall height 7’ 6 ½” Support Column: 4 3” Sch 40 aluminum posts 7’ height Post base plate: Aluminum 7” x 5/8” x 7” with bolt pattern that matches existing mounting holes on Robert S. Kerr gate 12 work platform. Fittings: All fittings to be first grade malleable iron, pressed steel or aluminum. Hardware must meet or exceed original specifications. Assembly The new canopy will be assembled onsite. Assembly methods are the responsibility of the contractor. 3.2 DELIVERY AND STORAGE Materials shall be delivered with 48 hour notice to the Robert S. Kerr Marine Terminal undamaged and stored out of contact with the ground. Materials that are damaged during the delivery or improper storage shall be replaced at no cost to the government. 3.3 GOVERNMENT FACILITIES The Contractor shall be furnished a laydown area at the RS Kerr marine terminal. 3.4 WARRANTY Contractor will guarantee warranty on all parts installed, and all completed work shall be free of any defects and poor workmanship for a period of 1 year from date of receipt and acceptance. All defects and poor workmanship found will be corrected with no extra charge to the government.
