BONDS A ten percent (10%) Bid Bond or certified check payable to the City of Orange and drawn on a solvent bank of the United States of America is required with bid in accordance with bond instructions. BOND INSTRUCTIONS Please fill in the following information and comply with the instructions as stated below: All bid bonds shall be submitted upon Standard AIA forms; or a satisfactory bond of an amount of not less than 10% of such bid as a guarantee that the bidder, if awarded a contract, will execute and deliver such contract to the City Purchasing Officer within fifteen (15) days after notice of award. If the Bidders to whom the contract is awarded fails or neglects to sign a contract with the City, including the filing of any required bonds and insurance documents within fifteen (15) days after notice of award, the City shall declare the bid security to be forfeited, and the money or bond for the bid security shall be deposited into the City Treasury. Genaral Scope of Works: Contractor shall furnish all tools and equipment necessary to test approximately 250 backflow devices. The actual number of devices fluctuates as new devices are added and existing devices are removed from inventory. Upon awarding of the contract, The City of Orange Water Division (Water Division) will provide the selected Contractor with a list of devices to be tested. 2. Contractor must be certified by Orange County Health Environmental Department and shall possess a current Orange County Health Care Agency Cross Connection Control and Backflow Assembly tester certification. Certification shall be maintained through the duration of the contract. 3. Contractor must be equipped with current calibrated testing gauge. Proper calibrations shall be done in accordance with the manufacturer, Orange County, and state requirements. If necessary, the Water Division will ask for records of calibration of devices. 4. Contractor shall complete testing of all devices and providing test reports to the City of Orange Water Division within 90 calendar days counting from the date of issuance of the Notice to Proceed. 5. Test Reports: Water Division will provide contractor with pre-printed test report form with specific information on each device. Contractor, upon completion of testing of the device, shall complete, sign and submit to the Water Division within five (5) days of the date of the test. 6. Contractor is responsible for all safety measures. Some devices are located in the center median of busy streets, and proper precautions must be taken. Contractor must be familiar with and practice all State and Federal OSHA codes and requirements. 7. Existing improvements, such as, sidewalk, walls, soft and hardscape, etc. are to be protected in place. Any damage to existing improvements shall be immediately reported to the Water Division and repaired or replaced at the Contractor's expense in a timely manner and to the satisfaction of the Water Division. 8. Contractor shall complete repairing of damaged devices within 90 calendar days counting from the day of issuance of Repair Authorization. 9. This contract shall be awarded for one year, with the option to extend for up to three additional years. The length of contract shall be determined based on the contractor's performance and funding availability. All construction work shall be performed in accordance with the specifications contained in the Request for Bids (general and special provisions), the current edition of "Green Book", and the City of Orange Public Works Department Standard Plans and Specifications. 12. Contractor shall, at all times, carry valid insurance, which meets all City of Orange insurance requirements as outlined in Attachment No. 2 Liquidated Damages: For each consecutive calendar day in excess of the time specified for completion of the work and submission of all paperwork, the Contractor shall pay the City or have withheld from noise due it, the sum of $250 per day.
