Site work for a water / sewer project in New Orleans, Louisiana. Completed plans call for site work for a water / sewer project.

The Board of Commissioners of the Port of New Orleans (Board) plans to perform site development at its proposed Louisiana International Terminal (LIT) on the Mississippi River in Violet, Louisiana. Site Development will consist of clearing, earthwork, ground improvement, new and relocated roads and bridges, new and relocated rail, new and relocated utilities, drainage features and a drainage pump station. The site development will be designed to accommodate the future construction of a container terminal capable of handling a throughput of approximately 2 million TEU (Twenty Foot Equivalent Unit) containers on an annual basis at full build-out. The Board intends to use the Construction Management at Risk (CMAR) delivery method for the Project, as authorized by Louisiana law pursuant to La. R.S. 38:2225.2.4. The Port of New Orleans is a landlord port. The Board is currently in negotiations with a third-party terminal operator/tenant to build, operate, and transfer the backland area of the terminal (container yard and ancillary facilities). As part of the negotiations, the Board intends to provide site access, utilities and ground improvements, and hand the prepared site over to the terminal operator for construction of the infrastructure and buildings needed for commercial opening. The terminal opening date and project budget are to be established during the terminal operator/tenant negotiations. The Board has applied for a Joint Permit Application (JPA) with the Louisiana Department of Natural Resources, Office of Coastal Management and the U.S. Army Corps of Engineers for Coastal Use and Section 10/404 permits, respectively, for construction of the Project. Because a portion of the terminal will be within 1500-feet of the Mississippi River levee, a U.S. Army Corps of Engineers Section 408 permission will also be required. The Board's intent is to have the CMAR Contractor on board to make the designs as constructible and cost-effective as possible through participation in the 30%-100% design process. A key objective of the CMAR methodology is to allow construction to begin immediately upon approval of the required federal permits. The Board intends to break the Site Development into several design packages: 1. Relocation of E. St. Bernard Hwy and associated utilities 2. Offsite terminal rail and relocation of the Chalmette Branch rail line 3. Access roads, drainage, earthwork and ground improvements 4. Drainage pump station 5. E. Judge Perez Drive interchange The Board intends to deliver the Site Development construction using a single CMAR contractor. The Board also intends to provide Independent Cost Estimating (ICE) and Construction Management (CM - including construction administration, materials testing and inspection) as 3rd party services contracted separately. The Board of Commissioners of the Port of New Orleans, an independent political subdivision of the State of Louisiana (hereinafter referred to as the "Board"), and [Consultant's name and legal address and corporate status] (hereinafter referred to as "Consultant") (the Board and Consultant are sometimes referred to herein individually as a "Party" and collectively as the "Parties"), do hereby enter into this agreement ("Agreement") for Professional Services for the Drainage Pump Station for the Louisiana International Terminal, as described in the Scope of Work, a copy of which is attached hereto as Exhibit "A" ("Scope of Work") and incorporated herein, under the following terms and conditions.
