The work involves the supply of all labour, equipment and materials to complete the work as described in the tender documents. The work, depending on location, shall include surface treatment of gravel roads. This contract includes roads that the City of Quinte West is committed to completing in 2023. This contract is generally awarded to a single supplier, however, the City reserves the right to award or not award this tender in whole or in separate contracts, at its sole discretion. The use of Geo-textile Reinforced Single Surface Seal Coat and/or Fog Coat will be considered where, after road preparation, it is evident that this product will be effective. Use of these materials will be at the sole discretion of the Manager of Outdoor Operations or their designate. Work on this Contract may commence after signing of the Contract agreement. The Contractor shall diligently prosecute his work on this Contract to completion on or before September 15, 2023. t is agreed by the parties to the Contract that in case all the work called for under the Contract is not finished or completed within the datesincluded, a loss or damage will be sustained by the Owner. Since it is and will be impracticable and extremely difficult to ascertain and determine the actual loss or damage which the Owner will suffer in the event of and by reason of such delay, the parties hereto agree that the Contractor will pay to the Owner the sum of $1000.00 (One Thousand Dollars) as liquidated damages for each and every calendar day’s delay in finishing the work in excess of the completion date prescribed. The City reserves the right without prejudice to accept or reject any or all submissions and to waive technical defects, irregularities, formalities and omissions at its sole discretion, if in doing so, the best interest of the City will be served.
