Sealed bids will be publicly opened and read for: RECYCLED RUBBER TIRE ASPHALT RESURFACING AT JOE WHEELER STATE PARK ALABAMA DEPARTMENT OF CONSERVATION AND NATURAL RESOURCES, STATE PARKS DIVISION IN ROGERSVILLE, ALABAMA PROJECT NO. 41-P-87 Scope of Work: The workshall generally consist ofmilling and grinding,paving, and striping approximately 6.75 miles ofroadway using recycledmaterial asphalt (RMA) inthe base bid. If funds permit, paving, sealcoating,and striping of additionallots, roadways, and 10,000feet of cart paths may beadded. All work shall be doneunder applicable StateLaws. The selected biddermust submit an executedcopy of the DisclosureStatement, required by Act2001-955 (Article 3B ofTitle 41, Code of Alabama,1975), within 10 days ofthe award. The DisclosureStatement may be submitted with your sealed bid. All parties interested in bidding this mustbe at the location on thatdate or contact must bemade with Terry Boyd at(334) 242-3836 or ChadDavis at (256) 247-5466prior to the conference. Ifyou need directions or asite visit before the scheduled conference, pleasecontact Mr. Chad Davis. Submission of Bids:Sealed bids must be accompanied by a certifiedcheck or bid bond in anamount not less than fivepercent (5%) of the contract bid price, but not toexceed Ten Thousand Dollars ($10,000). No bidsshall be accepted after thetime stated for receipt ofbids. Evaluation/Award: Theaward will be made to theresponsible bidder quotingthe lowest total cost to theDepartment. The Department reserves the right tocompare specific items, atits discretion, to determinethe lowest responsible bidder. It is anticipated that theaward will be made withinthirty (30) days of the bidopening. Performance Bond: Aperformance bond in theamount of 100% and aPayment Bond in theamount of 100% of thecontract price will be required of the successfulbidder. Laws / Ordinances: TheContractor shall observeand comply with all federal,state, and municipal laws,ordinances, rules, and regulations that would apply tothis project. Open Trade: By submittinga bid, proposal, or qualification, the submitter represents that he/she and thebusiness entity he/she represents is not currently engaged in the boycott of aperson or entity based in ordoing business with a jurisdiction with whom the Stateof Alabama can enjoy opentrade, as defined in Act2016-312. Immigration / E-Verify: Incompliance with the Beason-Hammon AlabamaTaxpayer and Citizen Protection Act, as a conditionfor the award of any contract by the state to a business entity or employerthat employs one or moreemployees, the businessentity or employer shallprovide documentation establishing that the businessentity or employer is enrolled in the E-Verify program. The successfulbidder will be required toacknowledge that it will notviolate federal immigrationlaw or knowingly employ,hire for employment, orcontinue to employ anunauthorized alien withinthe State of Alabama. Non-Discrimination: TheDepartment of Conservation and Natural Resourcesdoes not discriminate onthe basis of race, color, religion, age, sex, pregnancy,national origin, genetic information, veteran statusor disability in its hiring oremployment practices norin admission to, access to,or operations of its programs, services, or activities. Force Majeure: In thecase of a Force MajeureEvent as defined herein,DCNR reserves the right toimmediately terminate theAgreement without priornotice to Concessionaire.Should this occur, neitherParty shall be liable for orbe considered in breach ofthis Agreement due to anyfailure to perform its obligations as a result of a causebeyond its control, including, without limitation: (i)acts of God; (ii) flood, fireor explosion; (iii) actions,embargoes, quarantines,or blockades in effect on orafter the date of this Agreement; (iv) national, state, orregional emergency,whether ongoing or occurring on or after the date ofthis Agreement; (v) publichealth emergencies, outbreak, epidemic, or pandemic, whether ongoing oroccurring on or after thedate of this Agreement, including, without limitation,COVID-19; or (vi) any otherevent which is beyond thereasonable control of suchparty (each of the foregoing, a "Force MajeureEvent"). General Information: Forcontracts in excess of$50,000, Contractor mustbe licensed as a GeneralContractor. Title 34, Chapter 8, Code of Alabama,1975. The Department reserves the right to rejectany or all bids or to waiveany informalities in the bidding. All responses received will be subject to theAlabama Open RecordsAct, Ala. Code 36-12-40,(1975), as amended, andmay be subject to publicdisclosure upon request.
