Renovation of a transportation facility in Louisville, Kentucky. Completed plans call for the renovation of a transportation facility.

This project will include replacement of the existing centerline, edge and touchdown zone light fixtures, the PAPIs, and various airfield signs within the safety area of Runway 17L/35R. Successful Bidders shall be required to pay at least prevailing wage rates established by the United States Secretary of Labor. Each sealed Bid shall be accompanied by an irrevocable Bank Letter of Credit, or satisfactory Bid Bond (see Attachment #8) with good corporate surety, in a sum not less than ten percent (10%) of the aggregate amount of the Bid, payable without condition to the Louisville Regional Airport Authority, to guarantee that if the Bidders offer results in an Award, the Bidder will furnish all required bonds, insurance certificate(s) and insurance policy(ies) within ten (10) Calendar Days after the Notice of Award is given, and enter into the Contract within thirty (30) Calendar Days after the Notice of Award is given. No contract will be awarded unless and until the Federal Aviation Administration approves and awards an Airport Improvement Program grant for this Project and concurs with the Authoritys recommendation for the award. Contractors at every tier must comply with all applicable federal requirements, including but not limited to: the Buy American Preference, Foreign Trade Restriction, Davis Bacon Act, Affirmative Action Requirement, Governmentwide Debarment and Suspension, Governmentwide Requirements for Drug-Free Workplace. The proposed Contract is under and subject to Executive Order 11246 of 24 September 1965 and its subsequent revisions. Bidders will be required to comply with the affirmative action plan for Equal Employment Opportunity prescribed by the Office of Federal Contract Compliance (OFCC), United States Department of Labor in Chapter 60, Regulations of the Secretary of Labor (41 C.F.R Chapter 60), or by other relevant orders of that office. A certification of nonsegregated facilities must be submitted prior to the award of a federally-assisted construction contract exceeding $10,000 which is not exempt from the provisions of the Equal Opportunity Clause. Contractors receiving federally assisted construction contract awards exceeding $10,000, which are not exempt from the provisions of the Equal Opportunity Clause will be required to provide for the forwarding of the notice to prospective subcontractors for supplies and construction contracts where the subcontracts exceed $10,000 and are not exempt from the provisions of the Equal Opportunity Clause. The penalty for making false statements in offers is prescribed in 18 U.S.C. 1001. The Authority, in accordance with the provisions of Title VI of the Civil Rights Act of 1964, 78 Stat., 252, 42 U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Non-discrimination in Federally Assisted Programs of the Department of Transportation issued pursuant to such Act, hereby notifies all Bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprises will be afforded full and fair opportunity to submit Bids in response to this invitation and will not be discriminated against on the grounds of race, color, religion, sex, or national origin in consideration for an Award. The bidder/proposer shall make good faith efforts, as defined in Appendix A of 49 CFR Part 26, Regulations of the Office of the Secretary of Transportation, to subcontract 5.3 (5.3%) percent of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals (DBE). In the event that the bidder for this solicitation qualifies as a DBE, the contract goal shall be deemed to have been met. Individuals who are rebuttably presumed to be socially and economically disadvantaged include women, Black Americans, Hispanic Americans, Native Americans, Asian-Pacific Americans, and Asian-Indian Americans. Individuals who are not presumed to be socially and economically disadvantaged, and individuals concerning whom the presumption of disadvantage has been rebutted, have the burden of proving, by a preponderance of the evidence, that they are socially and economically disadvantaged. The apparent successful competitor will be required to submit information concerning the DBEs that will participate in the contract. The information will include: (1) the name and address of each DBE; (2) a description of work to be performed by each named firm; (3) the dollar value of work of the contract; (4) written confirmation of the bidders commitment to use a DBE subcontractor whose participation it submits to meet a contract goal; (5) written confirmation from the DBE that it is participating in the contract as provided in the prime contractors commitment; and (6) if the contract goal is not met, evidence of good faith efforts as provided in 49 C.F.R Part 26. Award of the contract will be conditioned on meeting these requirements. A certified DBE is one that is certified by the Kentucky Department of Transportation. The Authority reserves the right to waive any informality in any Bid or Bid Guaranty, to reject any and all Bids and to negotiate with any Bidder to such extent as may be necessary The Authority has a No Contact Policy which prohibits communication or contact by Bidders(s) or its representative(s) directed at members of the Authoritys Board, its employees, its consultants, or its other representatives concerning the subject of the Bid Documents except as permitted by the Bid Documents. A. No Unauthorized Contact by Proposers. Upon the advertisement or other publication of notice of these Proposal Documents until such time as an Award is made with respect thereto, there shall be no communication or contact initiated by Proposers, potential Proposers, or their representatives directed at members of the Authoritys board, its employees, its consultants, or its other representatives concerning the subject of the Proposal Documents, except as permitted by these Proposal Documents. Communication with the designated POC is allowed. B. Unrelated Contact. If the Authority currently contracts with a Proposer, this policy shall not prohibit communications between the Authority and such Proposer to the extent they relate to the existing contract and not the subject of the Proposal Documents. C. Contact by the Authority. This policy shall not prohibit Authority employees or representatives from contacting a Proposer for the purpose of obtaining further information. D. Policy Violations. The Authority may reject a Proposal or response in the event of any violation of this policy. Any questions from the prospective Bidders will be accepted in writing until noon, Thursday, June 1, 2023. After this date no questions will be answered. Questions submitted should be directed to Brian Sinnwell at Engineering@flylouisville.com. All questions must be put on the Bid Question Form (See Attachment #7). The Authority will encourage the successful Bidder to enter into, and will assist the successful Bidder in securing, a project agreement, or other agreement, to reduce the risk of work stoppages or other labor related delays during the term of the Project. The Authority will encourage the successful Bidder to employ local labor for all but supervisory personnel for the Project.
