Each bid shall be accompanied by a proposal guaranty inthe form of a bid bond, executed by a corporate suretycompany, a bank cashier's check or a certified checkpayable to the City of Elmhurst for not less than fivepercent (5%) of the amount bid. The proposal guarantychecks of all, except the two lowest responsible bidders,will be returned after the proposals have been checked andtabulated. The proposal guaranty checks of the two lowestresponsible bidders will be returned after the contract andthe contract bond of the successful bidder have beenproperly executed and approved. Bid bonds will not bereturned. RIGHT TO REJECT BIDS The City of Elmhurst reserves the right to waivetechnicalities and to reject any and all proposals for anyreason deemed in the best interest of the City of Elmhurst. AWARD OF CONTRACT Unless all bids are rejected, the contract award will bemade to the lowest responsive responsible bidder. Indetermining who the lowest responsive responsible bidderis, the City of Elmhurst will consider all factors which it, inits discretion, deems relevant in determining who thelowest responsive responsible bidder is. Bidders who areawarded a contract shall be required to provide a Laborand Material Payment Bond and a Performance Bond,each in the total amount of the contract sum uponexecution of the contract. PAYMENT OF PREVAILING WAGES The general prevailing rate of wages in DuPage County foreach craft or type of worker or mechanic needed to executethe contract or perform the work, also the generalprevailing rate for legal holiday and overtime work, asascertained by the Illinois Department of Labor, shall bepaid for each craft or type of worker needed to execute thecontract or to perform the work.
