Work described in this section includes clearing and grubbing site, protecting adjoining property and trees as indicated on the drawings or as specified herein. The work shall include the complete removal and satisfactory disposal of all growth including trees, stumps, logs and roots; organic material, and other debris or items that interfere with construction operations. The site clearing operations shall be conducted in a manner to insure minimum interference with roads, streets, walks, and other adjacent occupied or used facilities. Liquidated Damages:$1,000.00 per day for each day beyond the Final Completion Date Each bid shall be accompanied by a bid bond of five percent (5%) of the bid executed by a surety company licensed under the laws of North Carolina to execute the Contract in accordance with the bid bond and upon failure to forthwith make payment, the surety shall pay the obligee an amount equal to the amount of said bond. Said deposit shall be retained by the Owner as liquidated damages in event of failure of the successful bidder to execute the Contract within ten (10) days after the Notice of Award or give satisfactory surety as required by law. Performance and Payment Bonds are required in the amount of 100% of the Contract amount and shall be furnished by the Contractor. Fayetteville Public Works Commission reserves the right to reject any or all bids for any reason determined by PWC to be in its best interest.
