Bids shall be enclosed in a sealed envelope bearing the name and address ofthe Bidder and labeled "LEONIA SENIOR CENTER RESTROOM AND ENTRANCEWAY ADA IMPROVEMENTS-PHASE III". Separate sealed bids for: GENERAL CONTRACT: LEONIA SENIOR CENTER RESTROOM AND ENTRANCEWAY ADA IMPROVEMENTS-PHASE III All work incidental thereto, including but not limited to the Leonia Senior Center Restroom and Entranceway ADA Improvements-Phase III and as required in accordance with the Project Manual. Bidders electing to receive the specifications from a third party, or any other service or entity assume the responsibility of ensuring they receive any issued revisions or addenda Bidders must be authorized to do business in New Jersey. Any Bidder which is a corporation not chartered under the laws ofthe State ofNew Jersey, must submit an affidavit certifying that said corporation is authorized to do business in the State ofNew Jersey. Bids must be accompanied by a guarantee in the amount of 10% ofthe bid, but not in excess of $20,000.00, in the form of a certified check, cashier's check or bid bond. The rules and regulations cited in 24 CFR 92.351(b), 24 CFR 85.36(e) (i-vi), and OMB Circular A-102 on this topic specify that proactive outreach efforts to include MBE-WBE-DBE must be undertaken as part ofthe open competition process for contract opportunities funded with CDBG and other federal dollars. The sub-grantee-and its contractors and subcontractors - are, therefore, required to provide the maximum practicable opportunity for MBEWBE-DBE's to participate in the procurement process. All contracts and subcontracts for construction or purchase ofmaterials are subject to Section 3 ofthe Housing and Community Development Act of 1968 where to the greatest extent possible, opportunities for training and employment shall be given to lower income residents ofthe project area, and when possible, contracts shall be awarded to business concerns owned by area residents. The Owner reserves the right to waive any informalities in bids and to reject any and all bids ifit is in the best interest ofthe Owner to do so.
