Anyone submitting a bid who is so listed will be determined to be a non-responsive Bidder in accordance with 40 CFR 31. Bidders on this work will be required to comply with the President's Executive Order No. 11246 in regard to non-discrimination in employment. Enrollment in Federal Work Authorization program Bidders are informed that pursuant to Section 285.530, RSMo, as a condition of the award of any contract in excess of five thousand dollars ($5,000.00), the successful bidder shall, by sworn affidavit and provision of documentation, affirm its enrollment and participation in a federal work authorization program with respect to the employees working in connection to the contracted services. Successful bidders shall also sign an affidavit affirming that it does not knowingly employ any person who is an unauthorized alien in connection to the contracted services. Safety training Bidders are informed that the Project is subject to the requirements of Section 292.675, RSMo, which requires all contractors or subcontractors doing work on the Project to provide, and require its on-site employees to complete, a ten (I 0) hour course in construction safety and health approved by the Occupational Safety and Health Administration ("OSHA") or a similar program approved by the Missouri Department of Labor and Industrial Relations which is at least as stringent as an approved OSHA program. The training must be completed within sixty (60) days of the date work on the Project commences. On-site employees found on the worksite without documentation of the required training shall have twenty (20) days to produce such documentation. Authorized employees Contractor acknowledges that Section 285.530 RSMo, prohibits any business entity or employer from knowingly employing, hiring for employment, or continuing to employ an unauthorized alien to perform work within the state of Missouri. Contractor therefore covenants that it is not knowingly in violation of subsection I of Section 285.530RSMo, and that it will not knowingly employ, hire for employment, or continue to employ any unauthorized aliens to perform work on the Project, and that its employees are lawfully eligible to work in the United States. The City reserves the right to reject any and all bids, to waive informalities or irregularities, and to determine the lowest responsive and responsible bidder, and to award the contract on that basis. All Bidders must agree that such rejection shall be without liability on the part of the City for any damage or claim brought by any Bidder because of such rejection, nor shall the Bidder seek any recourse of any kind against the City because of such rejection. The filing of any Bid in response to this invitation shall constitute an agreement of the Bidder to these conditions. Building addition to the Parks Maintenance Building for a restroom, add restroom to Public Works Shop Building, renovate the existing Public Works Men's Restroom to a new Women's Restroom and add a new Men's Restroom/Locker Room. B. The city reserves the right to add or delete portions of the work to meet budgetary requirements. All work will be performed under a single contract. 1.2 LOCATION A. The project is located within the jurisdictional boundaries of the City of Osage Beach. 1.3 REFERENCED SPECIFICATIONS A. Missouri Department of Transportation (MoDOT) Standard Specifications for the Construction of Highways is referenced within several specifications in the General Requirements and Technical Specifications of this contract. In such specifications the following shall apply: 1. The work of the applicable specifications of this contract shall be accomplished in accordance with the Missouri Department of Transportation Specifications for the Construction of Highways of the latest edition with the exceptions or additions noted within these specifications. 2. The provisions of Division One, General Conditions of the MoDOT Standard Specifications for Highway Construction are specifically deleted from this contract. All administrative items pertaining to the work of this contract shall be as specified herein. B. Any references to the "COMMISSION" shall be interpreted to mean the CONTRACTING OFFICER. All references to the "ENGINEER" shall be interpreted as to the CONTRACTING OFFICER.
