Bid Title: Water Treatment Chemicals This Invitation for Bid is for Water Treatment Chemicals for Water Treatment for the City ofWellington Water Department. Any necessary additional details/specifications are attached The City may cancel an Invitation for Bid and reserves the right to accept or reject any or all bids/proposals and waive informalities, ifit is determined to be in the best interest ofthe City Please submit this completed Invitation to Bid form along with all required and any applicable information. BID PROCEDURES/INFORMATION o A bid submitted must not be contingent, dependent, or conditional on any other bid. o Bids submitted should be sealed. o Any and all variances to requested specifications shall be specifically stated in the bid. o Bids must specify any and all warranties and include available information. o Bids submitted must include a W9 form when applicable, if form not already on file with the City. o Bids submitted by mail or otherwise shall clearly identify the bid number and bid title on the outside of the envelope. If submitted electronically, bid number and bid title should be clearly referenced. o If a bid is sent via electronic means to the City Clerk's Office, it will be sealed immediately upon receipt. It is the vendor's responsibility to verify the bid was received, (It is recommended that the vendor call the City Clerk's Office prior to and after sending. Ph 620-326-2811) o Bids submitted must include proof of minimum bonding and insurance requirements, when applicable. o Any bid submitted, that indicates opening of the bid is considered acceptance and award of such bid, shall be rejected without opening. o Anti-Discrimination Clause. The contractor agrees: (a) to comply with the Kansas Act Against Discrimination (K.S.A. 44-1001 et seq.) and the Kansas Age Discrimination in Employment Act, (K.S.A. 44-1111 et seq.) and the applicable provisions of the Americans With Disabilities Act (42 U.S.C. 12101 et seq.) [ADA] and to not discriminate against any person because of race, religion, color, sex, disability, national origin or ancestry, or age in the admission of access to or treatment or employment in, its programs or activities; (b) to include in all solicitations or advertisements for employees, the phrase "equal opportunity employer"; (c) to comply with the reporting requirements set out in K.S.A. 44-1031 and K.S.A. 44-1116; (d) to include those provisions in every subcontract or purchase order so that they are binding upon such subcontractor or vendor; (e) that a failure to comply with the reporting requirements of (c) above or if the contractor is found guilty of any violation of such acts by the Kansas Human Rights Commission, such violation shall constitute a breach of contract; (f) if the contracting agency determines that the contractor has violated applicable provisions of ADA, that violation shall constitute a breach of contract; (g) if (e) or (f) occurs, the contract may be cancelled, terminated or suspended in whole or in part by the City. Parties to this contract understand that subsections (b) through (e) of this paragraph number 5 are not applicable to a contractor who employs fewer than four employees or whose contract with the City totals $5,000 or less during this fiscal year. MINIMUM BONDING REQUIREMENTS o Performance Bond, bond on the part of the contractor for 100% of the contract price for any contract exceeding the sum of $100,000 for the purpose of making any public improvements, or constructing any public building or making repairs on the same or in other instances that the City Manager deems appropriate and when required by law. Pursuant to K.S.A. 60-1111. PERFORMANCE BOND required for this bid: All construction contractors and subcontractors are to carry Workman's Compensation Insurance, as required by State law, for all employees who work on City of Wellington premises, as well as: Manufacturer's and Contractor's Public Liability Insurance as appropriate for the project. (Minimum requirement - $1,000,000) Property Damage Insurance to protect them from claims for property damage. (Minimum requirement - $1,000,000) Any and all additional insurance required by the laws of the State of Kansas. If any subcontracting is let, prime contractors will be required to ensure the subcontractors comply with the provisions of this plan and with all applicable required federal and state regulations Bid Security shall be required when the City Manager deems it appropriate or when required by law. If required, bids received for contracts shall be accompanied by a bid security through the provision of a certified check, cashier's check, or bid bond in the amount often percent (10%) of the proposed bid price, payable to the City of Wellington. Failure to provide the required bid security may be grounds for rejection of the bid THE CITY OF WELLINGTON has decided to bid out the chemicals that are used for processing potable water on a biannual basis due to the economy and the amount ofrequests for price increases throughout the past year. Scope ofbids: The city is requesting bids for the following chemicals. Please bid on as many or few as you wish. This will be for the remaining months ofthe calendar year for 2023. Ifyou are bidding Pyrophosphate, it needs to be FDA approved and you will need to provide services listed below: 1. Monthly collection and replacement of coupons at 3 different coupon station locations. 2. Laboratory analysis on monthly and quarterly coupons for corrosion rate. 3. Supply laboratory analysis results/trends by email to Water Plant supervisor. 4. Recommendations throughout the year based off corrosion analysis reports. We will need the cost per lb. for each chemical you are bidding, with delivery cost included. If you are bidding Pyrophosphate, include any service cost. The Water Plant is located at 511 South West Lake Rd. Wellington, Ks 67152.
