Site work and paving for a mixed-use development in Livingston, Tennessee. Completed plans call for site work for a road / highway; for paving for a road / highway; sidewalk / parking lot; sidewalk / parking lot; and water / sewer project.

Project will rebid in December. The Project consists of upgrading sidewalk, stormwater, lighting, parking, and utility upgrades from South Court Square (SR-52/SR-58) approximately 650 ft south of Cedar Street, and necessary stormwater and utility improvements continuing an additional 450 ft south of Cedar Street to Railroad Street. The work will be awarded in one contract. The Instructions to Bidders, Bid, Contract Agreement, Drawings, Specifications and Forms of Bid Bond, Performance Bond, Payment Bond, and other Contract Documents may be examined at the following: City of Livingston City Office 301 McHenry Circle Livingston, TN 38570. Each bid must be accompanied by a Bid Bond, prepared in the form of a Bid Bond attached to the Contract Documents or a Surety Company's Standard Bid Bond, duly executed by the Bidder as principal and having as surety thereon a surety company licensed to do business in the State of Tennessee and listed as a certified company in the latest issue of U.S. Treasury Circular 570, in the amount of five percent of the bid. Bidders must comply with the President's Executive Order Nos. 11246 and 11375, and as supplemented by Department of Labor regulations (41 CFR, Part 60), which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Copeland "Anti-Kickback Act" (18 U.S.C. 874) as supplemented in Department of Labor regulations (29 CFR, Part 3), Davis-Bacon Act (40 U.S.C. 27 (a) to (a)-7), and Sections 103 and 107 of the Contract Work Hours and Safety Standards Act as amended (40 U.S.C. 327-330) as supplemented by the Department of Labor regulations (29 CFR, Part 5). Bidders must comply with all applicable standards, orders, and requirements issued under Section 306 of the Clean Air Act (42 U.S.C. 1857(h) and Section 508 of the Clean Water Act (33 U.S.C. 1368)), Executive Order 11738, and Environmental Protection Agency regulations (40 CFR, Part 15), which prohibits the use of facilities included on the EPA List of Violating Facilities. The provision shall require reporting of violations to DCA and to the U.S.E.P.A. Assistant Administrator for Enforcement (P.L. 94-163). Bidders must comply with all applicable requirements of the Brooks Morkowski Compromise, Convict Labor Requirements (18 U.S.C. 436) and the Historic Sites Act. Contracts must recognize mandatory standards and policies relating to energy efficiency which are contained in the State energy conservation plan issued in compliance with the Energy Policy and Conservation Act (P.L. 94-163). Bidders must certify that they do not, and will not, maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed, or national origin. The Contractor/Subcontractor will comply with 41 CFR 60-4, in regard to affirmative action, to ensure equal opportunity to females and minorities and will apply the timetable and goals set forth in 41 CFR 60-4. No contract or subcontract will be awarded to a Japanese citizen or national, a firm controlled directly or indirectly by Japanese citizens or nationals, or a supplier of any product if more than 50 percent of the total cost of the product is allocable to production or manufacture in Japan. Any Bid submitted from such firms or suppliers shall be declared nonresponsive and rejected. Disadvantaged Business Enterprises (DBE) Requirements. Any contract or contracts awarded by the Owner through this advertisement for bids will be funded by a State Revolving Fund (SRF) loan from the State of Tennessee. State and Federal funds will be involved in this Project and, as a result, Bidders must comply with the SRF Loan Program's Disadvantaged Business Enterprises (DBE) requirements, including contacting a minimum of 10 qualified DBE sub-contractors, professional service providers, vendors, and/or suppliers by certified mail to solicit bids. The apparent successful Bidder must submit to the Owner copies of the certified letters and return receipts prior to Contract award. Neither the State of Tennessee nor any of its departments, agencies, or employees is or will be a party to this Invitation for Bids or any resulting contract(s) awarded by the Owner. Qualified Disadvantaged Business Enterprises (DBE) firms may also contact Barge Design Solutions at the address above, in order to obtain a list of prospective bidding General Contractors or to obtain copies of bidding/contract documents. Compliance with Davis-Bacon wage rate provisions is a requirement of this Project. The allotted time for construction is 90 calendar days. No bid may be withdrawn within 90 calendar days after the scheduled time for receipt of bids. All bidders must be licensed and shall comply with all requirements of the State of Tennessee Contractor's Licensing Act. The Owner will in no way be liable for any costs incurred by any bidder in the preparation of its Bid in response to this Invitation to Bid. The successful Bidder for this Contract will be required to furnish a satisfactory Performance Bond and Payment Bond each in the amount of 100 percent of the Bid. The Owner reserves the right to reject any or all Bids, to waive informalities, and to re-advertise.
