Design-Builder shall perform all design and construction services, and provide material, equipment, tools and labor, necessary to complete the Work described in and reasonably inferable from the Contract Documents. The project scope includes engineering design services, permit acquisition, easement acquisition, material procurement, construction, and commissioning services for the new sewer assets. Design services shall include planning, sequencing, and scheduling the work to replace sewers without spills, overflows, or unreasonable interruption of service. Plan a sequence of work to commence construction as soon as practicable following preliminary engineering design, and to continue simultaneous design and construction to complete the project. Design-Builder understands that if Substantial Completion is not attained by the Scheduled Substantial Completion Date, Owner will suffer damages which are difficult to determine and accurately specify. Design-Builder agrees that if Substantial Completion is not attained by 670 days of Substantial Completion Date, (the "LD Date"), Designer-Builder shall pay Owner two thousand ($ 2,000), as liquidated damages for each calendar day that Substantial Completion extends beyond the LD Date. Design-Builder understands that if Final Completion is not achieved within 60 days of the Substantial Completion Date, Owner will suffer damages which are difficult to determine and accurately specify. DesignBuilder agrees that if Final Completion is not achieved within 60 days of Substantial Completion, DesignBuilder shall pay to Owner two thousand ($ 2,000), as liquidated damages for each calendar day that Final Completion is delayed beyond the above-referenced number of days.
